No unauthorized person shall uncover, make any
connections with or opening into, use, alter or disturb any public
sewer or appurtenance thereof without first obtaining a permit from
the Town. The owner of the property with any such unauthorized connection
or use shall be liable to the Town for all sewer use resulting from
such connection or use and may be subject to criminal fines and/or
penalties.
All costs and expenses incident to the installation,
connection and disconnection of the building sewer shall be done by
the owner. The owner shall indemnify the Town from any loss or damage
that may directly or indirectly be occasioned by the installation,
connection and disconnection of the building sewer.
A separate and independent building sewer shall
be provided for every dwelling, building or property used for human
occupancy, employment, recreation or other purpose. A building sewer
shall not service more than one:
A. Dwelling house, either detached or one side of a double
house or house in a row of houses, provided that a garage, a guesthouse
and similar features incidental to the family life shall be considered
as a portion of the dwelling.
B. Industrial, commercial or manufacturing establishment.
C. Building separated from adjacent buildings by a party
wall or walls and comprising apartments, stores, offices or any combination
thereof.
D. Detached building comprising apartments, stores, offices
or any combination thereof.
E. Establishment consisting of individual dwelling units
under the management of a single commercial or cooperative entity.
Old building sewers may be used in connection
with new buildings only when they are found, on examination and test
by the Town, to meet all requirements of this Part 1.
The connection of the building sewer into the
public sewer and the size, slope, alignment and materials of construction
of the building sewer and the methods to be used in excavating, placing
of the pipe, jointing, testing and backfilling the trench shall all
conform to the requirements of this Part 1.
The applicant for the building sewer permit
shall notify the Town when the building sewer is ready for inspection
and connection to the public sewer lateral. Inspection of the building
sewer shall be conducted by the Town. The connection shall be made
under the supervision of the Town.
All excavations for building sewer installations
shall be adequately guarded with barricades, and barricades and lights
at night, so as to protect the public from hazard. Streets, sidewalks,
parkways and other public property disturbed in the course of the
excavation/installation work shall be restored in a manner satisfactory
to the Town. All state highways and rights-of-way must be permitted
through the Delaware Department of Transportation and conform to the
state's specifications.
The Town may require any person to provide such
information as the Town deems appropriate to determine whether any
action or activity undertaken by such person or on such person's property
is in compliance with the requirements of this Part 1, poses a threat
to human health and the environment or interferes with the health,
safety, peace, comfort or convenience of the general community.
