Since there is danger to life and property inherent in the use of plumbing
installation, water supply and drainage, this chapter shall regulate the installation,
alteration or repair of plumbing systems, water supply, drainage and vents
on all real property within the Town of New Hartford.
All plumbing installations heretofore mentioned shall be made in conformity
with the requirements of New York State Building Codes, except where the provisions
of this chapter or any other local law or ordinance or the Building Code of
the Town of New Hartford shall differently prescribe, in which event compliance
with the provisions of such local law, ordinance or Building Code shall be
recognized as proper compliance with this chapter. The requirements of the
New York State Plumbing Code shall be those known as the "New York State Plumbing
Code," as approved by the New York State Uniform Fire Prevention and Building
Code, January 1, 1984.

Schedule of fees for plumbing inspections. The schedule
of fees for plumbing inspections shall be as follows:

All inspectors of the Codes Department are hereby authorized and deputized
as agents of the Town of New Hartford to make inspections and reinspections
of all plumbing installations heretofore and hereafter described and to approve
or disapprove the same.

It shall be the duty of the inspectors to report, in writing, to the
chief building inspector, whose duty it shall be to enforce all the provisions
of this chapter, all violations of or deviations from or omissions of the
plumbing provisions of the New York State Plumbing Code and all local laws,
ordinances and the Building Code as referred to in this chapter, insofar as
any of the same apply to plumbing systems. The inspectors shall make inspections
and reinspections of plumbing installations in and on properties in the Town
of New Hartford upon the written request of an authorized official of the
Town of New Hartford or as herein provided. The inspectors are authorized
to make inspections or reinspections of plumbing systems installations and
equipment in and on properties within the town where it is deemed necessary
for the protection of life and property. In the event of an emergency, it
is the duty of the inspectors to make plumbing inspections upon the oral request
of an official or officer of the Town of New Hartford.
Any person committing an offense against any provision of this chapter
shall, upon conviction thereof, be guilty of a violation pursuant to the Penal
Law of the State of New York, punishable by a fine not exceeding $250 or by
imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment.
The continuation of an offense against the provisions of this chapter shall
constitute, for each day the offense is continued, a separate and distinct
offense hereunder.
The provisions of this chapter shall not apply to the plumbing installations
in mines, ships, railway cars or automotive equipment or the installations
or equipment employed by a railway, electrical or communication utility in
the exercise of its function as a utility, and located outdoors or in buildings
used exclusively for that purpose. This chapter shall not apply to any work
involved in the manufacture, assembly, test or repair of plumbing machinery,
apparatus, materials and equipment by a person, firm or corporation engaged
in plumbing manufacturing as his principal business. It shall not apply to
any building which is owned or leased in its entirety by the government of
the United States or the State of New York.

This chapter shall not be construed to relieve from or lessen the responsibility
of any person owning, operating, controlling or installing any plumbing systems,
devices, appliances or equipment for loss of life or damage to person or property
caused by any defect therein.
This chapter shall take effect immediately upon the filing of the same
in the office of the Secretary of State.
