GENERAL REFERENCES
Subdivision of land — See Ch. 257.
This chapter shall be known as the "Enhanced 911 Local Law of the Town of New Windsor."
This chapter is intended to establish and improve regulations requiring the assignment and display of street address numbers of buildings and property in the Town of New Windsor in order to make the location of such property readily identifiable to police, fire departments, emergency medical personnel and other emergency agencies, volunteer or otherwise, of the Town of New Windsor.
The E-911 Town Coordinator of the Town of New Windsor shall have the authority to assign numbers to every parcel of real property within the Town of New Windsor as it exists as of the effective date of this chapter. After the effective date of this chapter, numbers shall be assigned to new tax parcels, created by subdivisions or otherwise, by the E-911 Town Coordinator of the Town of New Windsor prior to final Planning Board approval. The owner of every parcel of real property within the Town of New Windsor, as it exists as of the effective date of this chapter, shall be notified in writing of the number assigned to the parcel of real property if that street address number has changed. For this purpose, notice given prior to the effective date of this chapter by the County of Orange with respect to any parcel of real property within the Town of New Windsor pursuant to the adoption of numbers with respect to the Enhanced 911 system shall be deemed notice for the purposes of this section.
Each owner or agent of the owner or occupant of real property within the Town of New Windsor having received notice of the number assigned to the parcel of real property shall, within 60 days from the effective date of this chapter, be responsible for displaying and maintaining the display and the number of said parcel of real property in accordance with this chapter as follows:
A. 
Commercial property (nonresidential).
(1) 
In the event that the parcel contains one building with but one number assigned to it, the number of the parcel of real property shall be conspicuously displayed on the face of the building, the face being the side facing the street of address, and shall be readily readable from that street without the aid of any artificial lens or lenses. In the event that the parcel contains more than one building and more than one number is assigned to the parcel, the numbers of the parcel of real property shall be conspicuously displayed on the respective face of each such building, the face being the side containing the main entrance facing the street of address. If the number is not legible from the street, it shall also be posted on a gate, post, mailbox, fence or other appropriate structure (i.e., a sign). It shall be within 20 feet of the road pavement of the street of address, adjacent to the driveway for such property, and shall be readily readable from that street without the aid of any artificial lens or lenses. Wherever practicable, said number shall be placed near some light or source of illumination so that it may be readily seen at night. If the number is to appear on a mailbox, the number shall be placed on both sides of the mailbox, or a single number may be placed on the exterior portion of the door on the mailbox.
(2) 
No certificate of occupancy or "no violation" letter shall be issued by the Building Department until the number has been affixed in accordance with this chapter. An affidavit of compliance sworn to by the owner or tenant shall be acceptable evidence of compliance.
B. 
Residential property.
(1) 
On each parcel of improved residential property, the number shall be conspicuously displayed on the face of the building or manufactured home, the face being the side facing the street of address which it fronts, and shall be readily readable from the street without the aid of any artificial lens or lenses. The number of the building shall be conspicuously displayed on the respective faces of each such building. Apartments, condominiums and like structures shall also post the range of numbers of the apartments and/or condominiums located in each structure. If the number is not legible from the street, it shall also be posted on a gate, post, mailbox, fence or other appropriate structure (i.e., a sign). It shall be within 20 feet of the edge of the road pavement and adjacent to the driveway of such property and shall be readable without the aid of an artificial lens or lenses. The number shall be so placed that it will not be obstructed by trees, shrubbery, porches or other extensions of the building. Wherever practicable, said number shall be placed near some light or source of illumination so that it may be readily seen at night. If the number is to appear on a mailbox, the number shall be placed on both sides of the mailbox, or a single number may be placed on the exterior portion of the door of the mailbox.
(2) 
No certificate of occupancy or "no violation" letter shall be issued by the Building Department until the number has been affixed in accordance with this chapter. An affidavit of compliance sworn to by the owner or tenant shall be acceptable evidence of compliance.
C. 
Prohibition. The display of any street address number other than the number assigned by the Town of New Windsor is prohibited.
D. 
Size of numbers. For residential, the displayed numbers shall be four inches in height. For commercial, the displayed numbers shall be no less than eight inches in height nor more than 12 inches in height. Storefronts or unit numbers shall be preceded by the word "Suite" or letter "S" as may be required by the E-911 Town Coordinator.[1]

E. 
Number type. The displayed numbers shall be block Arabic numerals.
F. 
Color. The color of the displayed numbers must contrast with its background color.
A. 
New subdivisions. Prior to final approval of the Planning Board, any subdivision which has one or more private roads or proposed new Town roads shall be named by the developer or owner. All private road names and proposed new Town roads shall be approved by the office of the E-911 Town Coordinator prior to Planning Board approval.
B. 
Existing properties. For the purposes of Enhanced 911, any private road or driveway which has three or more buildings or separate parcels or building lots served by a private road or driveway shall be considered a private road. The private road shall be named by those persons whose property adjoins said private road and reported to the E-911 Town Coordinator. If the private road is not so named within 90 days of the date of the enactment of this chapter, a name shall be recommended by the E-911 Town Coordinator to the Town Board, which shall then name the private road.
C. 
Duplicate name. The private road name(s) or proposed new Town road name(s) that is selected shall not duplicate the name of an existing street or be a similar sounding name so as to be easily confused with that of an existing named street.
D. 
Signage. Each private road and each proposed new Town road name selected and approved shall be posted by street signs at each intersection of the roads. All signs shall be similar in terms of construction and character to those signs installed by the Town of New Windsor for public roadways. In all cases, the private road signs shall state the name of the private road, followed underneath with the words "Private Road" in smaller letters. For private roads existing and not signed at the date of this chapter, the New Windsor Highway Superintendent shall purchase and install the signs. In all new subdivisions the signs shall be in place prior to issuance of any building permits or construction of any structures and shall be paid for by the owner or developer.
Any owner or agent of the owner of real property within the Town of New Windsor who violates any of the provisions of this chapter shall be guilty of a violation and shall be subject to a fine not to exceed $250 or imprisonment not to exceed 15 days, or both. Each day on which such violation continues shall constitute a separate violation.
