A violation of this chapter, and any failure to comply with an order
to remedy after due service, and any violation of any requirement of this
chapter or any statement, plan, application, permit or certificate approved
or issued under the provisions of this chapter, shall be considered an offense
punishable by a fine of not more than $150 or imprisonment for a period not
to exceed 15 days, or both, for conviction of a first offense, and, upon conviction
of a second offense both of which were committed within a period of five years,
punishable by a fine of not less than $350 nor more than $700 or imprisonment
for a period not to exceed 30 days, or both, and, upon conviction for a third
or subsequent offense, all of which were committed within a period of five
years, punishable by a fine of not less than $700 nor more than $1,000 or
imprisonment for a period not to exceed six months, or both.
In any case where a provision of this chapter is found to be in conflict
with a provision of any other ordinance, local law or code of the municipality
existing on the effective date of this chapter, the provision which establishes
the higher standard shall prevail.

To the extent this chapter may violate any affordable housing requirements
of the Federal Department of Housing and Urban Development, the violating
sections shall be null and void.
This chapter shall be read in conjunction with Chapter
300, Zoning, Chapter
287, Water, Chapter
240, Sewers, and sanitary laws, as per the Code of the Town of New Windsor.
