There is hereby established a new Zoning Law for the Town of
New Windsor, which law is set forth in the text and map that constitute this chapter. Said law is adopted for
the purposes set forth in §§ 261 and 278 of the Town
Law, which, in the interest of the protection and promotion of the
public health, safety and welfare, shall be deemed specifically to
include the following, among others to:
A. Provide adequate development standards to ensure a balanced and orderly
pattern of future growth and economic stability.
B. Ensure that future growth is coordinated with the Town's ability
to provide adequate municipal services.
C. Promote a safe and efficient circulation network which will serve
the various types and intensities of pedestrian and vehicular traffic
generated by future development within the Town.
D. Protect the natural features of the Town, including but not limited
to wetlands, lakes, reservoirs, streams and riverfront, from filling,
erosion and pollution.
E. Provide for the present and future residents of the Town by encouraging
the development of a balanced variety and quantity of sound housing
opportunities for all segments of the population.
F. Ensure adequate land resources for housing, industry and commerce.
G. Provide for the gradual elimination of nonconforming uses.
H. Protect and enhance the community's appearance.
I. Ensure the efficient and adequate provision of public facilities
and services.
J. Protect residential areas and provide privacy for families.
K. Encourage flexibility in the design and development of land in such
a way as to promote the most appropriate use of lands, to facilitate
the adequate and economical provision of streets and utilities and
to preserve the natural and scenic qualities of open lands.
L. Make provisions for, in accordance with § 263 of the Town
Law, as amended by Chapter 295 of the Laws of 1956 and as further
amended by Chapter 742 of the Laws of 1979, the accommodation of solar
energy systems and equipment and access to sunlight necessary therefor.
