A.
Legislative intent. The Township has caused engineering
and traffic investigations and studies to be performed in accordance with
the regulations promulgated by the Pennsylvania Department of Transportation
to determine the safe speeds for traffic upon highways within the Township.
The Board of Supervisors, in order to provide for the health, safety and general
welfare of the residents of New Garden Township, and of travelers operating
within and through the Township, desires to establish speed limits on highways
or parts of highways within New Garden Township in accordance with those studies
and investigations as well as the historically established speed limits of
such highways.
B.
Speed limits. The maximum speed at which a vehicle may
proceed on or along those highways or parts of highways within New Garden
Township, Chester County, Pennsylvania, described below, is hereby established
(or are hereby ratified if previously established) at the rate of speed indicated,
for the length of the entire streets listed as follows:

shall fully and completely stop the vehicle as required by the Pennsylvania

B.
Enforcement and penalties. Any person convicted of a
violation of any of the provisions of this section shall be sentenced to pay
those fines and costs established by the applicable provisions of the Pennsylvania
Motor Vehicle Code, or any subsequent act of the General Assembly amending
said Vehicle Code. Disposition of said fine(s) shall be made in accordance
with the provisions of the Motor Vehicle Code or other applicable law.
A.
The following intersections are hereby established as
yield intersections, and official yield signs shall be erected (or are hereby
ratified if previously erected) in such a position as to face traffic approaching
the through street on the yield street in the direction(s) indicated for that
intersection. Every driver or operator of a vehicle approaching the intersection
on the yield street, in the direction indicated herein, shall slow down or
otherwise stop the vehicle in accordance with the requirements of the Pennsylvania
Motor Vehicle Code, and then yield the right-of-way as required by the Vehicle
Code.

B.

Vehicle restrictions established.

It shall be unlawful for any person or operator to drive
any motor vehicle, Class B or larger, as defined in the Pennsylvania Motor

Notwithstanding the foregoing, nothing herein shall prohibit
any driver from driving a vehicle of Class B or larger, as defined in the
Pennsylvania Motor Vehicle Code, on any part of any such street when it is
necessary to do so in order to pick up or deliver any goods, wares, merchandise,
or other material from or to any premises located on any such street, or portion
of such street, or any premises located on another street where there is no
other means of access to that street.
