Editor's Note: Former Art. XIV, H/B Highway Business District, was repealed 2-9-2009 by Ord. No. 181.
In addition to the general goals listed in the statement of purpose and community development objectives in Article I, the R-4 Residential Zoning District is intended to:
A. 
Establish a new residential zoning district intended to convert existing nonconforming residential uses within the Hartefeld subdivision into uses by right.
B. 
Provide for higher densities and a variety of housing types and community recreational facilities to meet the current and projected housing needs of the Township.
C. 
Direct high-density residential uses to locations with direct access to major highways and commercial areas; and
D. 
Encourage the preservation of open space through the use of a residential cluster development option.
The following use regulations apply to Hartefeld Sections A, B, C, D, E, F, H, I and J:
A. 
By-right use regulations. A building may be erected, altered, or used, and a lot or premises may be used, by right, for the following purposes, and no other, in accordance with regulations set forth in this chapter:
(1) 
Single-family detached dwelling.
(2) 
Residential accessory buildings and structures in accordance with § 200-9.
(3) 
Minor home occupation in accordance with § 200-124.
(4) 
Renewable solar energy facility with an array area of 1,000 square feet or less in accordance with § 200-127.
(5) 
New Garden Township municipal use.
B. 
Special exception regulations. The following use may be permitted on a lot as a special exception when authorized by the Zoning Hearing Board, subject to the standards of this section and Article XX of this chapter:
(1) 
Solar energy facility with an array area greater than 1,000 square feet in accordance with the provisions of § 200-127.
C. 
Conditional use regulations. The following uses may be permitted on a lot as a conditional use when authorized by the Board of Supervisors, subject to the standards of this section and Article XIX of this chapter.
(1) 
Community facilities.
(2) 
Country club/golf course.
(3) 
Major home occupation in accordance with § 200-124.
D. 
Area and bulk regulations.

A. 
By-right use regulations. A building may be erected, altered, or used, and a lot or premises may be used, by right, for any one of the following purposes and no other in accordance with the regulations set forth in this chapter:
(1) 
Single-family detached dwelling.
(2) 
Residential cluster development when in accordance with Article XV.
(3) 
Residential accessory buildings and structures, provided that they are incidental to the primary use, that is, decks, sheds, patios, detached garage, swimming pool and similar buildings and structures as defined in § 200-8.
(4) 
Agricultural use in accordance with § 200-117.
(5) 
Renewable energy facility less than 1,000 square feet of area in accordance with the provisions of § 200-127.
(6) 
Minor home occupation in accordance with § 200-124.
(7) 
New Garden Township municipal use.
B. 
Uses by special exception. Only one of the following uses may be permitted on a lot when approved by the Zoning Hearing Board as a special exception subject to the standards of this section and Article XX of this chapter:
(1) 
Bed-and-breakfast, subject to the provisions of § 200-123.
(2) 
Renewable energy facility with an array area greater than 1,000 square feet, in accordance with the provisions of § 200-127.
C. 
Conditional use regulations. Only one of the following uses and no other may be permitted on a lot as a conditional use when authorized by the Board of Supervisors, subject to the standards of this section and Article XIX of this chapter:
(1) 
Major home occupation, in accordance with § 200-124.
(2) 
Group day care homes and day care facilities in accordance with § 200-121.
(3) 
Lot averaging in accordance with § 200-111.
(4) 
Rehabilitation facility.
D. 
Area and bulk regulations. The following area and bulk requirements shall be applicable to all uses permitted in the R-4 Residential Zoning District by right, special exception and conditional use not otherwise included in § 200-87D:

(2) 
Minimum lot width.
(a) 
Minimum lot width shall be 150 feet measured at both the street right-of-way line and the building setback line.
(b) 
Minimum lot width on a cul-de-sac shall be 50 feet on the turnaround portion measured at the street line and shall be minimum of 150 feet at the setback line.
(3) 
Maximum height of structures. All buildings and structures, except farm-related structures, shall not exceed 40 feet.
(4) 
Impervious coverage provisions. Unless otherwise stated in this chapter, total lot coverage for uses within the R-4 Residential District other than Hartefeld Sections A, B, C, D, E, F, H, I, and J which shall include all ground covered by buildings, sidewalks, parking areas, and similar impervious surfaces, shall not exceed 35% of the net lot/tract.
A. 
All development within the R-4 Residential Zoning District shall adhere to the design criteria standards set forth in Chapter 200 of the New Garden Township Code of Ordinances, being the Township Zoning Ordinance.
B. 
Public sewer and water: in accordance with § 200-15.1.
