This Part 2 shall be known and cited as the "Town of Bedford Local Law No. 1-1982 Regulating Parking for the Handicapped."
The Town of Bedford recognizes that the regulation of parking to facilitate the needs of handicapped or severely disabled citizens is significant and necessary as an aid to those citizens specifically, and is also significant and necessary generally, for the health, safety and welfare of all of the citizens of the Town of Bedford, and this Part 2 is intended to provide such control and regulation.
As used herein, the following words shall have the meanings below set forth:
HANDICAPPED OR SEVERELY DISABLED PERSON
Any person having any one or more of the following impairments, disabilities or conditions which are permanent in nature:
A. 
Has limited or no use of one or both lower limbs.
B. 
Has a neuromuscular dysfunction which severely limits mobility.
C. 
Has a physical or mental impairment or condition which is other than those specified above, but is of such nature as to impose unusual hardship in utilization of public transportation facilities, and such condition is certified by a physician duly licensed to practice medicine in this state as constituting an equal degree of disability (specifying the particular condition) so as to prevent such person from getting around without greater difficulty.
D. 
A blind person.
SPECIAL MUNICIPAL PARKING PERMIT
Those specific parking permits that the Commissioner of Motor Vehicles has distributed to the Town of Bedford, which permit entitles handicapped or severely disabled persons to park in any area of the Town of Bedford which has been so designated by the State of New York, County of Westchester or Town of Bedford as a place for parking for handicapped or severely disabled persons. The design of such permits shall be as determined by the Commissioner of Motor Vehicles, and such permits shall be issued upon application by any handicapped or severely disabled person who is a resident of the Town of Bedford.

Any person who stops, stands or parks a motor vehicle in a space clearly marked for use by the handicapped without displaying a special municipal parking permit or whose motor vehicle is not registered in accordance with § 404-a of the Vehicle and Traffic Law of the State of New York and is not actually being used for the transportation of a handicapped or severely disturbed person shall be subject to a fine not exceeding $100 for the first offense, by a fine not exceeding $200 for the second offense and by a fine not exceeding $500 for the third and any subsequent offenses.
