This Part
4 is adopted pursuant to the provisions of § 1660, Subdivision (a)17, of the Vehicle and Traffic Law of the State of New York.

The Town Board, after consultation with the
Town Commissioner of Public Works, hereby determines that the use
of Town roads by tractor-trailer trucks, dump trucks, garbage trucks
and other vehicles of a commercial nature with gross vehicle weights
in excess of 10,000 pounds has resulted in severe damage to the pavement
and underlying base of said highways, including cracking, crumbling,
settling and sinking of the highway surfaces. The Town Board further
determines that said highways were not originally designed or constructed
to accommodate use by commercial vehicles, and that continued use
by such vehicles will likely result in further destruction and deterioration
of the highways. The Town Board further determines that the safety
of the public as pedestrians and bicyclists on Town roads is at risk
from the continued use by commercial vehicles.
As used in this part, the following terms shall
have the meanings indicated:
COMMERCIAL VEHICLE
Includes any motor vehicle, including but not limited to
automobiles, trucks, buses and the like, utilized in conducting business
for a profit.
DESIGNATED TRUCK ROUTE SYSTEM
The network of NY State and Westchester County owned roads
in the Town of Bedford, including Routes 35, 117, 22, 684, 172, 121,
and 137, Long Ridge Road, and Greenwich Road.

GROSS VEHICLE WEIGHT RATING
The weight of a vehicle consisting of the unladen weight
and the maximum carrying capacity recommended by the manufacturer
of such vehicle.

Effective immediately, all Town roads within
the geographical limits of the Town of Bedford are permanently closed
to commercial vehicles with a gross vehicle weight rating in excess
of 10,000 pounds. Commercial vehicles with a gross vehicle weight
rating in excess of 10,000 pounds shall use the designated truck route
system.

A. Section
117-45 shall not be construed to prohibit the delivery or pickup of merchandise, other property, or services along any highway from which such vehicles and combinations are excluded. However, such exception shall require that any such delivery or pickup be made along a route incorporating the shortest direct route possible from and back to the designated truck route system.
B. Governmental and public utility vehicles, or any vehicles used for the purpose of public conveyance, are specifically exempt from the weight restrictions otherwise imposed on Town streets in §
117-45.

The Town Commissioner of Public Works shall
post notices in conspicuous places along Town roads for which weight
restrictions have been imposed by this Article in order to apprise
the public of such weight restrictions.
Any violation of the provisions of this Article
shall subject the violator to a fine of $250, or imprisonment for
a period not to exceed 15 days, or both such fine and imprisonment.
Each day shall constitute a separate violation.
