There is hereby established a Municipal Court to be known as the "Municipal
Court of the Borough of Cresskill."
The Court shall have an Official Seal bearing the impress of the name
of the Court.
The Judge of the Court shall be known as the "Municipal Judge," who
shall be nominated by the Mayor and confirmed by the Borough Council. In cases
of a tie vote among the Borough Council upon such nomination, the Mayor shall
cast the deciding vote. If the Mayor fails to make a nomination within 30
days after the expiration date of the incumbent Judge's term of office, or
if the Borough Council fails to appoint the person or persons so nominated
within 30 days after the nomination is submitted to it, or if the Borough
Council shall fail to appoint any person or persons nominated by the Mayor
within 60 days after the expiration date of the incumbent Judge's term of
office, then, in any of these events, the Mayor's power to nominate shall
thereupon be at an end, and the President of the Council shall then make the
nomination in the same manner as the Mayor might have done.
No person shall be appointed as Municipal Judge who does not possess
the qualifications provided in N.J.S.A. 2A:8-7.
The Municipal Judge shall serve for a term of three years from the date
of his appointment and until his successor is appointed and qualified.
The Court shall have an Administrator and a Deputy Court Administrator,
who shall serve for a term of one year from the date of their appointment
and until their successors are appointed and qualified. They shall be appointed
in the same manner as herein provided for the appointment of the Judge. They
shall, before entering upon the duties of their office, take and subscribe
an oath in accordance with law.
The Court shall sit in the Borough Hall or at such other place as the
Municipal Judge may designate and at such times as he may designate.
The Mayor and Council shall provide for the necessary supplies of the
Court upon requisition of the Administrator thereof.
All documents and papers signed and sealed by the Administrator or Judge
of the Court shall be given full faith, credit and obedience as provided by
law.
The functions, duties, jurisdiction and powers of the Court shall be
those now or hereafter provided by law.

A. An additional fine of $10 shall be imposed over the present
charges for violations of all local ordinances.
B. The fee for use of the services of the Municipal Public
Defender shall be as assessed by the Judge, up to a maximum allowable assessment
of $200.
