In accordance with the provisions of N.J.S.A. 39:4-8, 39:4-197.3 and 40:67-16.9, the governing body of the City hereby authorizes the Director of Public Safety to close any street under local jurisdiction for a period of time up to 48 continuous hours and to declare an emergency under certain conditions.
The Director of Public Safety is hereby authorized to provide by regulation for the closing of any streets or parts of streets under local jurisdiction to motor vehicle traffic for a period of time up to 48 continuous hours if the Director determines that it is necessary for the health, safety or welfare of the public. Any regulation to close any street under local jurisdiction for a period of time greater than 48 continuous hours must be approved by the Commissioner of the Department of Transportation. The Chief of Police shall erect proper warning signs notifying the public of the closure of the street.
The Director of Public Safety is hereby authorized to declare an emergency when accidents, fires, public celebrations, road construction or weather conditions require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Whenever the Director of Public Safety declares an emergency, it shall remain in effect until the declaration is removed. The Director of Public Safety may, through police agencies under his control, determine and control the direction of the flow of traffic and the parking of motor vehicles on streets under local jurisdiction. Traffic may be detoured, diverted or rerouted. Parking of motor vehicles may be prohibited on certain streets.
For the purpose of carrying into effect the provisions of this article, the Chief of Police is authorized to erect directional signals and temporary "Emergency No-Parking" signs. He also may assign police officers for the manual direction of traffic if necessary. The effectiveness of these regulations is contingent upon signs being erected as required by law. Notification that "Emergency No-Parking" signs are being posted shall be given to the operator or owner of any vehicle which was parked prior to the posting of the signs.
A. 
During any state of emergency, no motor vehicle shall be parked on any streets or parts of streets where "Emergency No-Parking" signs have been erected.
B. 
Whenever snow has fallen and the accumulation is such that it covers the streets, an emergency shall exist, and no vehicle shall be parked on any streets or parts of streets described in Schedule 19 of Article X, attached to and made a part of this chapter. These parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently so that parking will not interfere with the normal flow of traffic.
C. 
Any unoccupied vehicle parked in violation of these regulations shall be deemed a nuisance and a hazard to the safe and proper regulation of traffic. Any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from the removal before regaining possession of the vehicle.
D. 
Unless another penalty is expressly provided by New Jersey statute, any person who shall be convicted of parking a vehicle in violation of this article shall pay a fine of $12 for each offense.
