The purpose of this article is to regulate the
manner in which persons shall conduct themselves in public buildings
and on public lands within the City to ensure the protection of the
public health, safety and welfare, and the protection of public property.
As used in this article, the following terms
shall have the following meanings unless the context clearly indicates
that a different meaning is intended:
PERSON
A natural person, association, corporation, firm, partnership,
trust or other legal entity.
PUBLIC BUILDING
Buildings owned or leased by the City of Millville where
governmental functions or operations are conducted, and the adjacent
grounds and parking lots owned or leased by the City.
PUBLIC LAND
Ball fields, beaches, land, parks, playgrounds and recreational
areas within the City owned or leased by the City of Millville or
the Millville Board of Education.

A. Legislative findings. The governing body of the City
finds that the regulation of bicycles, rollerblades, roller skates,
skateboards and similar devices near public buildings and on public
lands is an important public concern and is necessary to promote the
public health, safety and welfare and the protection of public property.
B. Prohibition. It shall be unlawful for any person to
operate or use bicycles, rollerblades, roller skates, skateboards
or similar devices on or adjacent to the following public buildings
and public lands:

C. Parental responsibility. It shall be unlawful for
a parent or guardian of a juvenile knowingly to permit or by inefficient
control to allow such juvenile to violate this section of the Municipal
Code. The term “knowingly" includes knowledge which a parent
or guardian should reasonably be expected to have concerning the whereabouts
of a juvenile in that parent's or guardian's control. This section
is intended to set a reasonable community standard of parental responsibility
through an objective test. It shall not be a defense that a parent
or guardian is completely indifferent to the activities, conduct or
whereabouts of the juvenile.

Any person who is convicted of an offense under
this article shall be sentenced to pay a fine not to exceed $1,000,
to make restitution for property damage, to perform community service
not to exceed 30 days or to be incarcerated for a period not to exceed
30 days, or any combination of the foregoing within the discretion
of the court.
