The purpose of this article is to regulate the
manner in which all persons shall conduct themselves on the Waterfront
Park Marina to insure the protection of the public health, safety
and welfare, and the protection of private and public property including
the environment.
As used in this article, the following terms
shall have the following meanings unless the context clearly indicates
that a different meaning is intended.
DOCKAGE
A charge for the use of a dock or docking accommodations.
DOCKING
To bring or maneuver a boat, vessel or yacht into a dock
for temporary layover.
FISHING
The act of catching fish, or the diversion, occupation or
technique of attempting to catch fish.
MARINA
A location adjacent to or on the water offering docking accommodations
and other services for small craft.
PERSON
A natural person, association, corporation, firm, partnership,
trust or other legal entity.
WATERFRONT PARK MARINA
Being within public lands further described as being located
along the westerly side of Ware Avenue and along the easterly bank
of the Maurice River, running from Main Street (NJ Rt. 49) to approximately
750 feet (more or less) south to a termination point near the curve
of Ware Avenue, also being the common line with the beginning of the
City boat dock lease parcels. Said public marina facility in its entirety
also includes all public infrastructure, including but not limited
to pedestrian sidewalks, bikeways, passive areas, lighting, sight
furnishings, landscaping, stabilized shoreline, and transient dock
system, complete with ramps, floats, pilings, and accessories.
Any person violating any of the provisions of this article, shall, upon conviction thereof, be subject to the penalties set forth in Chapter
1, General Provisions, Article
III.
