A. 
It is the responsibility of local government to adopt regulations designed to promote the public health, safety and welfare. Such authority has been delegated to municipalities by the Legislature of the State of New Jersey.
B. 
The governing body of the City of Millville finds and declares that citizens have the right to safe and unobstructed passage on public property within the City.
C. 
The purpose of these regulations is to set forth standards and requirements for the location and use of dumpsters on public property within the City.
As used in this article, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended.
DUMPSTER
A roll-off container or a roll-off dumpster used for the collection of debris or building materials from renovated structures.
PERSON
A natural person, association, corporation, firm, partnership, trust or other legal entity.
PUBLIC PROPERTY
Alleys, lands, sidewalks, and streets owned by or under the jurisdiction of the City of Millville.
A. 
No person shall locate a dumpster on public property without first obtaining a permit from the City Clerk and paying a permit fee of $50 which may be issued for a period of time up to and including 30 days.
B. 
All persons seeking a dumpster permit shall complete an application on the form provided by the City Clerk. The application shall include a sketch of the location where the dumpster is to be located, and the application shall be reviewed and approved by Traffic Safety before a permit is issued.
C. 
No dumpster shall be placed within five feet of an adjacent property owners driveway.
D. 
No dumpster shall be placed at a location on a public street which interferes with the free flow of vehicular traffic.
E. 
No dumpster shall be placed at a site more than 24 hours prior to the beginning of construction nor remain at a site more than 24 hours after construction is completed.
F. 
Upon removal of any dumpster, the public property shall be swept clean of all loose debris and restored to its former condition.
G. 
Each dumpster shall prominently display the name, address and telephone number of the owner.
H. 
Each dumpster shall have both the front and rear surfaces reflectorized for night safety in such a manner as to indicate the height and width of same.
A person found guilty of an offense under this article shall be subject to a fine up to and including $500, or community service up to and including 30 days or imprisonment up to and including 30 days in the discretion of the municipal court.
