Pursuant to N.J.S.A. 40:55D-40.4, the State of New Jersey adopted Residential Site Improvement Standards, N.J.A.C. 5:21-1.1 et seq. The Legislature found and declared that it was in the public interest to avoid unnecessary costs in the construction process and that uniform site improvement standards would be both cost effective and predictable for developers.
All new streets in residential areas shall be constructed in accordance with the New Jersey Residential Site Improvement Standards, pursuant to N.J.A.C. 5:21-1.1 et seq. and any conditions set forth by the Planning Board of the City.
A. 
Upon completion of street construction in accordance with the aforesaid standards to the satisfaction of the City Engineer, the City Engineer shall certify to the governing body that the street in question is suitably improved and complies with all applicable performance standards and conditions set forth by the Planning Board of the City.
B. 
Certification may be extended with a performance guarantee approved by the governing body posted in an amount sufficient to cover the costs of the required uncompleted construction as established by the City Engineer in a form approved by the City Attorney which is adequate to protect the public health, safety and welfare for the special circumstances of the particular street.
