For the purposes of this chapter, the following terms, phrases and words shall have the following meanings:
LITTER
Any debris, dirt, sand, gravel, clay, loam, stone or building rubbish, hay, straw, sawdust, shavings or any other materials of any sort, or any manufacturing, trade or household waste, refuse or rubbish of any sort, or any manure, garbage or any organic refuse or offensive matter, or any food stuffs or food wrappers, utensils or containers, or any other discarded waste materials or scrap, consisting of paper, plastic or other materials or a mixture thereof.
MOTOR VEHICLE
Any device in, upon or by which any person or property is or may be transported or drawn upon a street, except devices moved solely by human power.

It shall be unlawful for any person, being the owner, driver or occupant of any motor vehicle, to throw, scatter, drop, deposit or spill or permit to be thrown, scattered, dropped, deposited or spilled any litter therefrom or permit the same to be blown off therefrom upon any public street, sidewalk, public parking area or other public place within the Village, except in Village receptacles specifically designed to accept the type and quantity of said litter, without the consent of the Village, or upon any private property within the Village, without the consent of the owner of such private property.
No person shall throw, scatter, drop, deposit or spill any litter upon any public highway, public street, public sidewalk, public parking area or other public place within the Village, except in Village receptacles specifically designed to accept the type and quantity of said litter, without the consent of the Village.
No person shall throw, scatter, drop, deposit or spill any litter upon any private property within the Village, without the consent of the owner of such private property.
In any prosecution of any violation of this chapter, it shall be an affirmative defense that the alleged violator had the consent of the Village or the owner of such private property to perform the act which is the subject of the alleged violation.
