[HISTORY: Adopted by the Board of Trustees of the Village

As used in this chapter, the following terms shall have the
meanings indicated:
County of Nassau.
A person established in the plumbing business as an individual,
member of a partnership, or officer of a corporation, and engaged
by contract or otherwise in the work of installing, setting up, or
putting together any plumbing fixtures, pipes, or appurtenances of
any kind, which are connected or are to be connected with the sewerage
system of a building or in the work of connecting such plumbing fixtures,
pipes, or appurtenances with a sewerage system.
The performance of any work on any sewerage system.
Includes the potable water supply distribution and sewer
lines and the water service pipes, both hot and cold; the fixtures
and fixture traps; the soil, waste, vent, and supply pipes; the house
drains; and the sewer lines, together with all their devices and appurtenances
and connections with or adjacent to the building or property.
A master or employing plumber license issued by a municipality
upon which the Village's plumbing license is based.
A.
No person shall hereafter engage in the business of plumbing within
the Village until such person shall have first obtained a Village
plumbing license from the Building Inspector.
B.
All applicants for a Village plumbing license shall:
(1)
Provide proof, satisfactory to the Building Inspector, that the applicant
has a current license as a master or employing plumber issued by the
county or by a town within the county. Upon application to the Board
of Trustees, a master or employing plumber with a current license
issued by any other municipality within the State of New York, whose
licensing requirements are substantially the equivalent of those established
by the county or one of the towns within the county, may request a
waiver of the requirement that he or she be licensed by the county
or a town within the county.
(2)
Pay such fee as shall be determined from time to time by resolution
of the Board of Trustees.
(3)
Provide proof, satisfactory to the Building Inspector, of such workers
compensation, disability, and liability insurance as shall be required
from time to time by resolution of the Board of Trustees.
C.
All such licenses shall be effective from the date of issuance until
December 31 of the year that they were issued.
D.
On or after November 1, an applicant may apply for a license for
the following calendar year.
A.
All plumbing work within the Village shall be performed by or under
the direct, daily, on-site supervision of an employing or master plumber
holding a Village plumber's license.
B.
No master or employing plumber shall directly or indirectly allow
his or her Village plumber's license to be used in connection
with work not actually done by such licensee or under such licensee's
supervision.
A.
Nothing in this chapter shall prohibit the employees of any public
authority, municipality, or special district of the Town of North
Hempstead from making water service line connections and performing
other plumbing work as a part of their employment with such authority,
municipality, or district without a Village plumber's license,
provided that the work is done in accordance with the provisions of
this Code.
B.
Nothing in this chapter shall prohibit the owner of a residence building
occupied or to be occupied by such owner and his or her family from
installing plumbing work in said building without a Village plumber's
license, provided that application is made and a permit is issued
for said installation and the work is done in accordance with the
provisions of this Code.
C.
Nothing in this chapter shall require a permit for the maintenance,
repair, or replacement of a sink, or other bathroom or kitchen plumbing
fixture or appliance.
A.
A Village plumber's license granted pursuant to this chapter
may be revoked by the Building Inspector, after 10 days' notice
to the licensee, upon a finding by the Building Inspector that the
licensee has violated the provisions of this chapter; that the licensee's
underlying license has expired or has been suspended or revoked; and/or
that one or more of the insurance policies upon which the license
was granted has or within the next 15 days will expire or be materially
changed. Such notice shall be sent by certified mail, return receipt
requested, to the licensee at the address of the licensee set forth
on the licensee's application.
B.
A licensee may appeal a notice of revocation to the Board of Trustees
within 30 days after the mailing of such notice. Such appeal shall
be filed with the Village Clerk with a copy served upon the Building
Inspector. Upon any such appeal, the licensee shall have a right to
be heard and to be represented by counsel. Such appeal shall not stay
the revocation of the license if the revocation is based upon the
suspension or revocation of the underlying license or the expiration
or material change of an insurance policy. In all other cases, the
revocation shall be stayed from the date that the notice of appeal
is filed with the Building Inspector until the hearing of the appeal.
If the appeal is not determined at the conclusion of the hearing,
the Board of Trustees shall determine whether or not to continue the
stay until the appeal is determined.
