[Adopted as Ch. 180, Art. IV, of the 1976 Code]
A. 
No curb, curb cut, gutter, sidewalk or driveway shall be constructed or reconstructed in any public street in the Village of Great Neck unless application to perform said work shall have been made in writing to the Village Clerk on blank forms provided by the Village. The application shall specify the location and character of the proposed improvements, and no work shall be done until a written permit, signed by the Village Clerk, has been issued on said application, the grade has been approved by the Village Superintendent of Public Works and, in the case of curb cuts, approval has been given as more particularly provided in § 485-27 hereof.

B. 
Such application, numbered consecutively, shall be executed in triplicate, one copy to be retained by the applicant, one copy by the Village Clerk and one copy to be forwarded to the Superintendent. The copy retained by the applicant shall be in the possession of the foreman or contractor on the site of the work and must be shown to the proper authorities when requested.

C. 
Each application for a curb cut shall be accompanied by a nonrefundable permit fee and a deposit to assure the proper replacement of all damaged curbs, both in such amounts as shall be prescribed from time to time by the Board of Trustees.

D. 
Each application for a permit hereunder shall also be accompanied by a certificate of insurance, in form approved by Village Clerk and issued by an insurance company authorized to do business within the state, running to the Village, guaranteeing that the applicant has provided public liability coverage of not less than $100,000/$300,000 and property damage insurance in the amount of not less than $50,000/$100,000 to save the Village harmless from all claims, actions and proceedings brought by any person for injury to person or property resulting from or occasioned by any fault or default by the Village or its employees or agents or by the person to whom the permit is issued or anyone acting thereunder. The policy shall also protect the Village in such amount as shall be prescribed from time to time by the Board of Trustees against any damage caused to any public street or other public property by reason of the work done pursuant to any permit issued hereunder.

E. 
All work is to be done in conformity with this article.

All sidewalks, curbs, gutters, driveways or pavement laid on any private street or on the streets of any new development shall be subject to the same regulations and must comply in all respects with the regulations governing Village streets. Failure to comply with the above will be sufficient cause for the Village to reject any proffered dedication of such streets.
A. 
No ashes, cinders or other material shall be placed in the roadway in such a manner as to interfere with the proper drainage.
B. 
The grade of the ground adjoining all sidewalks shall on one side be maintained sufficiently low to prevent the collection of water on the sidewalk.

A. 
No permit shall be issued for a curb cut until its size and location are first approved by the Village Superintendent of Public Works.
B. 
Not more than one curb cut shall be permitted for any single-family dwelling in the Village on a property with street frontage of less than 75 feet, except with the approval of the Board of Trustees after it obtains the advice of the Superintendent of Public Works. The width of the curb cut shall not exceed 18 feet.

C. 
The Committee of Architectural Review, after it obtains the advice of the Superintendent of Public Works, shall permit not more than two curb cuts, one curb cut having a maximum width of 18 feet and the other curb cut having a maximum width of 12 feet, for any single-family dwelling in the Village on property with street frontage of 75 feet or more.

D. 
In passing on applications for curb cut permits, the Superintendent of Public Works shall take into consideration the prospective character of the development, the traffic it will generate, the effect of said traffic upon existing public streets or proposed streets, the design and frequency of access and the extent to which such development may impair the safety and traffic-carrying capacity of the public streets affected.
E. 
In approving any application for two curb cuts pursuant to this section, the Committee of Architectural Review shall require a full landscaping plan for the front yard, to be subject to its approval.
F. 
The Building Inspector shall have the authority to require a survey to assure that any driveway that has been constructed with two curb cuts is in accordance with the approved plans.
As used in this article, the following terms shall have the meanings indicated:
CONTRACTOR
The party or parties contracting for or doing any work described herein, or authorized representatives of such party or parties.
ENGINEER
The Village Engineer or his authorized representative.
SUPERINTENDENT
The Superintendent of Public Works of the Village, or his designee, which may be, but is not required to be, the engineer, or such other person as may be designated from time to time by resolution of the Board of Trustees.

A. 
Before delivery on the job and at such other times as the Superintendent deems necessary, the contractor shall furnish any required samples of the materials hereafter mentioned. The materials used shall pass the following requirements:

(1) 
Concrete. All concrete used in the construction of sidewalks, driveway aprons, concrete curbs, street gutters and combination curbs and gutters shall have a compressive strength of at least 3,300 pounds per square inch at 28 days after the date it is poured and thereafter. All concrete shall be plant or transit mixed and shall be air-entraining concrete, with not more than 6% air-entrapment between 35° and 75° F., not more than 8% air-entrapment between 75° and 85° F. and not more than 10% air-entrapment above 85° F., (outside temperature in the immediate vicinity of the pour).
(2) 
Tests. Superintendent of Public Works or Building Inspector may require periodic tests of the compressive strength as evidence that the concrete installed meets design requirements. Tests shall be made in accordance with standard ASTM test procedures. At least three specimens shall be taken. The average compressive strength of test specimens shall be not less than required design strength, nor less than 3,300 pounds per square inch. All tests and testing shall be the responsibility of the contractor or developer.
B. 
Application. The foregoing specifications shall apply to all concrete work performed in the Village right-of-way, regardless of whether the work consists of new installations or replacements of existing installations.
A. 
Forms.
(1) 
Forms shall be of lumber two inches thick or of steel of equal strength, except on curves, where flexible strips may be used.
(2) 
They shall be held rigidly in place by stakes or braces with top edges at true line and grade given by the Superintendent. Ends of the adjoining forms shall be flush.

(3) 
The forms shall be set to give the walk a slope toward the curb of 1/4 inch per foot of width.
B. 
Division plates.
(1) 
Where division plates are used they shall be of one-eighth-inch steel, as wide as the depth of the slab and as long as the width of the walk.
(2) 
Forms and division plates shall be thoroughly cleaned and oiled each time they are used.
C. 
Subgrade.
(1) 
That portion of the ground surface directly beneath the slabs shall be called the subgrade.
(2) 
All soft and spongy material in the subgrade shall be removed and replaced with suitable material. Fills shall be compacted in layers not exceeding six inches in thickness. Areas previously compacted by traffic shall be loosened to a depth of six inches. The whole subgrade shall be thoroughly and uniformly compacted to a firm surface having, as nearly as possible, a uniform bearing power.
(3) 
A template, resting upon the side forms and having its lower edge at the exact elevation of the subgrade, shall be drawn along the forms before any concrete is laid. Any high places in the subgrade shall be removed so that the template will pass over without being raised off the side forms or being tipped at an angle to the sidewalk surface.
(4) 
The subgrade shall be damp, but not muddy, when concrete is placed upon it.
D. 
Drains. Where, in the opinion of the Superintendent, it is considered necessary to save the walk from damage by frost action, drains of four-inch tile shall be laid to the lines and grades given by the Superintendent.

E. 
Thickness and proportions.
(1) 
The sidewalk in residential areas shall consist of a four-inch thick course of concrete and shall be at least four feet wide.
(2) 
Sidewalks in areas designated as or zoned for business shall consist of a five-inch thick course of concrete and shall occupy the entire area between curb and building unless otherwise specified by the Board of Trustees on its own motion or on application of the abutting property owner.
F. 
Placing and finishing. The freshly mixed concrete shall be placed immediately on the prepared subgrade. It shall then be struck off and tamped with a straight-edge template resting upon the side forms and advanced with a crosswise sawing motion. It shall then be puddled and tamped and floated with a wood float until the surface has a true contour and the concrete is thoroughly compacted. The placing of concrete shall not be suspended for 45 minutes or longer except at the end of a slab. No concrete shall be placed on a frozen subgrade or when the temperature is or is liable within 24 hours, to be below 35° F. or above 95° F., except with the written permission of the Superintendent of Public Works.
G. 
Jointing.
(1) 
The walk shall be cut into separate rectangular slabs. No plain concrete slab shall be longer than six feet on any one side.
(2) 
Where division plates have been used they shall be removed after the concrete has hardened sufficiently to avoid breaking the edges or comers of the slabs.
(3) 
Where the division plates have not been used the partially set concrete shall be cut through to the subgrade. Care shall be taken to make the cut at right angles to the surface of the sidewalk.
(4) 
The surface edges of each slab shall be rounded to a radius of about 1/4 inch. Markings shall be exactly at cuts between slabs.
H. 
Expansion joints. Expansion joints shall extend from the surface to the subgrade and be truly at right angles to the sidewalk surface. They shall be placed as follows:
(1) 
At or near all places where the sidewalk line intersects a curbline or other sidewalk, a one-inch expansion joint shall be made at right angles to the center line of the walk.
(2) 
Where the sidewalk fills the space between the curb and the building line, a one-half-inch expansion joint shall be placed between the curb and the sidewalk and between the sidewalk and the building.
(3) 
A one-half-inch expansion joint shall be made across the walk at approximately fifty-foot intervals.
I. 
Curing.
(1) 
As soon as the concrete has set sufficiently, it shall be sprinkled and kept moist for 48 hours.
(2) 
The contractor shall protect the concrete from damage by rain, pedestrians and animals, with suitable covers and barricades and by red lights at night.
The foregoing specifications concerning terms, materials, forms, subgrades, drainage, subbase, mixing, placing, jointing and curing shall govern the construction of curbs and gutters and combined curbs and gutters, except as noted below:
A. 
Thickness.
(1) 
Curbs shall be at least six inches thick and at least 18 inches deep. The gutters shall have aprons at least 18 inches wide and shall be at least six inches thick.
(2) 
The combined curb and gutter shall be at least six inches thick, the curb 12 inches high and the apron at least 18 inches wide and six inches thick.
(3) 
The section of the curb, gutter or combined curb and gutter shall be of a design approved by the Superintendent.

B. 
Expansion joints. The curbs, gutters and combined curbs and gutters shall be cut into sections not longer than 20 feet and shall be provided with one-half-inch expansion joints every 50 feet at the ends of all curves.

The foregoing provisions under §§ 485-28, 485-29 and 485-30A, C, D, E, F, G, H and I shall govern the construction of driveways, except that all driveways within the street line shall be at least six inches thick and shall be of a design approved by the Superintendent.

The foregoing provisions under §§ 485-28, 485-29 and 485-30C and D shall govern Belgian block curb construction. The curb shall be constructed in the manner and according to the dimensions indicated in Village specifications.
A. 
Placing. The block shall be fixed in the concrete foundation course before same has set, followed immediately by the placing of the concrete backing course. The thickness of the cement plaster between the blocks shall be 3/4 inch minimum.
B. 
Proportions. Proportions used in the foundation and backing courses shall be one part portland cement to 2 1/2 parts sand and three parts coarse aggregate, and for the cement mortar, one part portland cement and two parts sand.
