The purpose of this chapter is to allow a Town Board to execute a lease
for recreational purposes as lessee for a term greater than the term of the
current Town Board.
The Town Board will determine on a case-by-case basis what is the most
appropriate term to be utilized in its negotiations as a lessee involving
leases for recreational purposes, and said term may exceed the term of the
Town Board.
This chapter will not be applicable to any lease involving dedicated
park land.
This chapter supersedes the Town Board's power to contract as set
forth in § 64 of the Town Law which limits, in certain cases, the
power to enter into a contract that exceeds the term of said Town Board.
This chapter does curtail the powers of future Town Boards, and therefore,
pursuant to the provisions of the New York State Constitution, Article IX,
§ 1, Subdivision [h], Paragraph [2], and Municipal Home Rule Law
§ 34, Subdivision 4, is subject to a permissive referendum.
