A. 
The Board of Plumbing Examiners shall consist of no fewer than five members, all of whom shall be appointed by the Town Board.
(1) 
Three of the members shall be master or journeyman plumbers, at least one of whom shall be a master plumber.
(2) 
One of the members shall be a member of the Town Board.
(3) 
One of the members shall be a layperson.
B. 
All members of the Board of Plumbing Examiners shall be appointed to serve three-year terms, except the Town Board member, who shall serve during his or her current term of office.
(1) 
One of the three plumbers who is a current member of the Board shall be designated to a term to end December 31, 2000; one to a term to end December 31, 2001; and one to a term to end December 31, 2002.
(2) 
The layperson of the Board shall be appointed to an initial term to end December 31, 2002.
(3) 
Their respective successors shall be appointed to three-year terms.
C. 
All members shall either be employees of the Town of Poughkeepsie, residents of the Town of Poughkeepsie, or a plumber licensed by the Town of Poughkeepsie.

A. 
The Board shall organize and function within 30 days after the adoption of this chapter and thereafter shall meet at such intervals as necessary to properly fulfill the duties of the Board, but in any case, not fewer than three times per year.
B. 
The Board shall have the authority to have jurisdiction over and to examine all persons desiring or intending to engage in the trade, business or calling of plumbing in the Town with the power of examining persons applying for certificates of competency to determine their fitness and qualifications for conducting the business of plumbers and to issue certificates of competency to all such persons who shall have passed a satisfactory examination before such Board and shall be, by it, determined to be qualified.
C. 
[1]The Board shall have the authority to charge and collect from each person applying for examination the sum as provided in Chapter 105, Fees, for each examination made by such Board, and all moneys so collected shall be paid over by the Board monthly to the Town Comptroller.

D. 
Hearings and revocation of certificates.

(1) 
The Board shall have the authority to conduct hearing on charges of:
(a) 
Incompetence; or
(b) 
For willful violation of this chapter.
(2) 
Upon a finding of guilt, the Board shall have the authority to impose penalties, including:

(a) 
A fine of not more than $1,000;
(b) 
Transferring a license ("covering"):
[1] 
For first offense: $1,000;
[2] 
For second offense: $2,000, with a suspension or revocation of plumbing license and/or suspension or revocation of certificate of competency;
(c) 
Failure to use i.d. stickers on trucks or vehicles: a fine of $100;
(d) 
At the discretion of the Board, a licensed plumber found to be conducting his business in a manner deemed unethical or unprofessional may be charged with a minimum fine of $500;
(e) 
Working without a permit.[2]

Editor's Note: Pursuant to L.L. 13-2021, adopted 11-3-2021, effective 1-1-2022, all fees will be in a Fee Schedule maintained in the Town offices, which fees may be amended from time to time by resolution.
(f) 
A suspension of the plumber's certificate of competency for a period of up to two years; or
(g) 
A revocation of the plumber's certificate of competency.
(3) 
All above violations in Subsection D(2), with the exception of "working without a permit," may be subject to license suspension or revocation.

E. 
Appeals. Plumbers found guilty of charges after a hearing may appeal the findings or the penalty imposed to the Town Board by filing a written notice within 30 days after the decision of the Board. The appeal shall be heard within 30 days after it is filed.
