This article shall be applicable to all territory
within the Town of Poughkeepsie outside of incorporated villages.

No person, owner or occupant shall pave, blacktop
or apply any other surfacing material, except for driveway sealer
applied as maintenance of an existing driveway, to any private driveway
abutting on Town highways unless such person, owner or occupant shall
have obtained a permit for such surfacing from the Town Superintendent
of Highways.
All plans and specifications in connection with
the proposed paving, blacktopping or surfacing of any private driveway
shall be subject to the approval of the Town Superintendent of Highways
before such permit shall be issued.

Any person who violates any provision of this
article shall be guilty of a violation and, upon conviction thereof,
shall be subject to a fine not exceeding $250 or to imprisonment for
not more than 15 days, or to both such fine and imprisonment. When
a violation of this article is continuous, each week thereof shall
constitute a separate and distinct violation.
