From and after the passage of this chapter no trees located on the sidewalks
of the streets, roads and alleys, or on private property where said tree or
trees shall extend over the sidewalk, of the Borough of Schwenksville, shall
be allowed to unnecessarily obstruct the light of the streetlights of the
Borough, and all trees so located shall be trimmed, close to the trunks up
at least 10 feet from the ground or sidewalk, unless on account of smallness
of the tree or trees the Street and Road Commissioner of said Borough may
otherwise order.
Whenever trees on the sidewalks or pavements, or extending over sidewalks
or pavements, are of great height, the Street and Road Commissioner may, at
his discretion, cause said tree or trees to be trimmed to such height exceeding
10 feet from the sidewalk and in such manner as he shall deem most desirable
and advantageous.
All the owners of trees on sidewalks and pavements of the streets, roads
and alleys of said Borough of Schwenksville or standing upon private property
shall trim said trees in such a manner that the branches thereof shall not
project beyond, extend or occupy at any height whatever more than 1/3
of the width of any street from curbline to curbline, unless on account of
the size or location of the tree or trees exceptions be made by the Street
and Road Commissioner of said Borough.
It shall be the duty of the Street and Road Commissioner of said Borough to give notice to all owners or occupiers, in front of or adjoining whose property any trees may stand which are not in conformity with the requirements of the §§
155-1,
155-2 and
155-3 of this chapter, to have the same properly trimmed, which notice shall be served upon the owner or owners by the said Street and Road Commissioner of said Borough; and if the party notified shall neglect or refuse so to do for the space of 10 days thereafter, then said Borough shall cause said tree or trees to be trimmed agreeably to the provisions of this chapter at the cost of the said owner or owners, to be collected in the same manner as debts are now by law collected.
Violations of this chapter are punishable for each offense by a maximum
fine of $1,000, plus costs of prosecution, and, in default of payment of such
fine and costs, by imprisonment for not more than 30 days.
