Subsequent to the adoption of this article, the outdoor display and/or
sale of goods on any public sidewalk, parking lot, private sidewalk or front
yard shall be in accordance with the provisions hereof.
As used in this article, the following terms shall have the meanings
indicated:
A sidewalk which is not owned or operated by the state, county or
other political entity.
A sidewalk either owned or operated by the Township of Franklin,
State of New Jersey or other political entity.
This article and its provisions, including penalties, shall be enforced
by the Township of Franklin and any other enforcement agencies designated
for the enforcement of the ordinances and codes of the Township of Franklin.
Sidewalk sales shall only be conducted between the hours of 9:00 a.m.
and 9:00 p.m.
Sidewalk sales shall not include sales of items in residential zones
commonly referred to as "garage sales."
Any sidewalk sales conducted in connection with a retail business operation
shall:
A.
Be limited to sales of items from stores located within
the Township of Franklin only and not from stores located outside the municipality.
B.
Be located, in the case of an individual store, immediately
in front of such store.
C.
Be conducted, in the case of a shopping center sale,
only immediately in front of or in close proximity to such store.
D.
Not cause any unreasonable interference with the flow
of vehicular or pedestrian traffic or otherwise create a public health or
safety hazard.
The following described sales shall be prohibited to be conducted as
sidewalk sales:
A.
Flea markets other than flea markets conducted or operated
by a not-for-profit or religious corporation, which shall be defined as outdoor
sales not primarily associated with sales located within a permanent indoor
structure.

B.
Sale of alcoholic beverages.
C.
Sale of food and beverages.
D.
Sale of pornographic materials.
No person shall obstruct the free and lawful passage of pedestrians
and vehicles on the streets and sidewalks of Franklin Township by placing
thereon any goods, wares, merchandise or other articles of trade or sale or
in any other manner whatsoever.
