A code regulating retail food establishments and fixing penalties
for violations is hereby established pursuant to N.J.S.A. 26:3-69.1
and 26:3-69.6. A copy of said code is annexed hereto and made a part
hereof without inclusion of the text in this chapter as permitted
by N.J.S.A. 26:3-69.2. In accordance with the provisions of N.J.S.A.
26:3A2-10c, all inspections, administration, regulation, enforcement
and issuance of permits, approvals and licenses under such code or
other applicable standards and regulations shall be undertaken by
the Burlington County Board of Health. No licensing by the Township
shall be required.
The code established and adopted by this chapter
is commonly known as the "Retail Food Establishment Code of New Jersey
(1965)."
Three copies of said Retail Food Establishment
Code of New Jersey (1965) have been placed on file in the office of
the Secretary of this local Board of Health upon the introduction
of this chapter and will remain on file there until final action is
taken on this chapter for the use and examination of the public.
Any person who violates any provision of or
order promulgated under this chapter, or code established herein,
shall, upon conviction thereof, be liable to a penalty of not more
than $2,000 for each violation. Each day a particular violation continues
shall constitute a separate offense.
