As used in this article, the following terms shall have the meanings indicated:
STREETS AND HIGHWAYS
The paved portions of all highways, roads and streets, including all shoulders, whether paved or unpaved, within the Town.
VEHICLES
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including licensed vehicles, except devices moved by human power or used exclusively upon stationary rails or tracks.
A. 
When any vehicle is parked or abandoned on any highway within this Town during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway upon which said vehicle is parked or abandoned, said vehicle may be removed by the Commissioner of Public Works/Superintendent of Highways or the Irondequoit Police Department.
B. 
When any vehicle is found unattended on any highway within this Town where said vehicle constitutes an obstruction to traffic, said vehicle may be removed by the Commissioner of Public Works/Superintendent of Highways or the Irondequoit Police Department.
C. 
When any vehicle is parked or abandoned on any highway within this Town where stopping, standing or parking is prohibited, said vehicle may be removed by the Commissioner of Public Works/Superintendent of Highways or the Irondequoit Police Department.
The parking of vehicles is hereby prohibited on all highways within the Town of Irondequoit between 12:00 a.m. (midnight) and 9:00 a.m. from November 1 to April 15.
After removal of any vehicle as provided in this article, the Commissioner of Public Works/Superintendent of Highways may store such vehicle to be stored in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the same upon payment to the Irondequoit Police Department or its designated agent of the amount of all expenses actually and necessarily incurred in effecting such removal, towing and storage as per the schedule established by the Town Board.
Any vehicles left abandoned or permitted to remain parked unattended in violation of this article shall be deemed a nuisance and a menace to the safe or proper regulation of traffic. The Commissioner of Public Works/Superintendent of Highways or any police officer may remove or cause to be removed any such vehicles to any location without any liability for damages to the vehicle. The owner or person in charge of such vehicle shall be required to reimburse the Town for the actual and necessary costs of removal and storage thereof before he or she is entitled to regain possession of said vehicle. Such reimbursement shall be in addition to any penalty for violation of this article.
It shall be the duty of the Commissioner of Public Works/Superintendent of Highways or the Irondequoit Police Department, as the case may be, to ascertain to the extent possible the owner of the vehicle or the person having the vehicle in his or her charge and to notify him or her of the removal and disposition of any vehicle removed as provided in this article and of the amount which will be required to redeem the same. The failure of the Commissioner of Public Works/Superintendent of Highways or the Irondequoit Police Department to ascertain the name of the owner of the vehicle or the person having charge of the vehicle or to notify him or her shall not in any way prevent the enforcement of this article or the towing of the vehicle or fixing of any fine.
Any person who violates any of the provisions of this article or any sections or subdivision thereof shall be guilty of an offense punishable by fine of not less than $25 and not exceeding $250. Each separate violation shall constitute a separate additional offense.
