For the purposes of this article, the following terms shall have the
meanings indicated:
GARBAGE
Waste food, papers, dead animals or parts thereof, wood, lumber or
vegetable matter of any kind, or any other matter which shall be flammable
or capable of fermentation or decay.
PERSON
An individual, society, club, firm, partnership, corporation or association
of persons; the singular number shall include the plural number.
RUBBISH
Waste metal, tin cans, ashes, cinders, glass, pottery and other similar
substances of a solid and incombustible nature.
TOWN
That portion of the Town of Monroe outside of the Villages of Monroe
and Harriman.
No person shall transport garbage or rubbish in the town except in a
vehicle having a securely closed and covered body or in a securely closed
container or containers.

No person, firm, partnership, corporation or other entity shall throw
or deposit or cause to be thrown or deposited any garbage, rubbish or other
debris in any public highway, street or place in the town, nor shall any person,
firm, partnership, corporation or other entity throw or deposit or cause to
be thrown or deposited any garbage, rubbish or other debris on any private
property without the consent of the owner thereof and in contravention to
the provisions of this article.

A. No person or owner shall store or keep or allow to be
stored or kept garbage or rubbish outside any dwelling, building or structure
occupied or owned by him, except in tightly covered metal or hard plastic
containers specifically designed for or adapted to that purpose.
B. No garbage shall be stored or kept outside any dwelling
or structure in plastic bags or paper bags or paper containers.

The provisions of §
28-4 hereof shall not apply to rubbish stored or kept outside on the days of the year designated by the Town of Monroe Superintendent of Highways for the spring and fall pickup of rubbish commonly called "clean-up days."

The Town Superintendent of Highways and/or any town constable are hereby
authorized to issue appearance tickets for a violation of this chapter in
the manner prescribed by law.

Any person who violates §
28-2 and/or §
28-4 of this article shall be guilty of an offense and shall, upon conviction thereof, be subject to a fine of not more than $250. Any person, firm, partnership or corporation who violates §
28-3 of this article shall be guilty of an offense and shall, upon conviction, be subject to a fine of not more than $5,000 or to imprisonment for a term not to exceed 15 days, or both.

As used in this article, the following terms shall have the meanings
indicated:
The dumping of all construction and demolition material within the Town
of Monroe is hereby prohibited.
A violation of this article shall be punishable by a fine not exceeding
$10,000 for each violation. Each day or part thereof that a violation continues
shall be deemed a separate violation.
The town will have the right to seek an injunction to prevent the violation
of this article.
