It is hereby declared and found that the public interest requires that
all swimming pools constructed before the adoption of Local Law No. 2 of 1965
(1965 Zoning Law) be fenced in the same manner as required in said Local Law
No. 2 of 1965.
For the purposes of this chapter, the following terms shall have the
meanings indicated:
SWIMMING POOL
Any constructed body of water or structure to contain water and any
related equipment pertaining thereto, whether or not the same is operated
for gain or profit, which is used or intended to be used for swimming or bathing,
constructed or installed prior to June 18, 1965.
The entire portion of the premises upon which such pool is located shall
be entirely enclosed with a good quality protective fence, which has been
approved by the Building Inspector of the Town of Monroe, of not less than
four feet in height. Every gate or other opening in the fence enclosing such
pool shall be kept securely closed and locked at all times when said pool
is not in use.

The violation of any provision of this chapter shall be an offense against
this chapter and shall be punishable by a fine of not more than $250 or imprisonment
for a period not exceeding 15 days for each offense, or by both such fine
and imprisonment. Every day that a violation of this chapter shall exist shall
constitute a separate and distinct violation.
The administration and enforcement of this chapter shall be under the
jurisdiction of the Building Inspector of the Town of Monroe, subject to the
direction of the Town Board of the Town of Monroe.
