There shall be a Board of Appeals, as provided
by law, consisting of five members, and two alternate members, one
or both of whom may serve, in the event that one or more members of
the Board are unable to participate in the hearing of an application
because of a conflict of interest, appointed by the Mayor, subject
to the approval of the Board of Trustees, for staggered five-year
terms, as provided in the Village Law. The Mayor shall appoint one
member as the Chair, subject to the approval of the Board of Trustees.

The meetings and procedures of the Board of
Appeals shall be governed by the provisions of the Village Law, as
amended from time to time. The Board of Appeals shall have the power
from time to time to adopt, repeal and amend the rules and regulations
governing its procedures and transaction of its business not inconsistent
with the Village Law or the provisions of this Code.

In addition to the authority to decide on variance and special use permit applications as specified in Chapter
310, Zoning, the Board of Appeals is also given the following jurisdiction:
A. To hear appeals for variances related to the requirements of Chapter
158, Fences, Walls and Plantings, Article
II, Fence and Wall Heights, of the Code.
B. To hear appeals for variances related to the requirements of Chapter
247, Signs, of the Code.

Public notice of any appeal or application pending before the
Board of Appeals shall be published by the Village Clerk in the official
newspaper of the Village of Scarsdale at least once and at least five
days prior to the date of the public hearing.
