Applications for licenses and permits shall be made as follows:
A. License to conduct alarm business. Any person engaged
in the business of owning, operating, maintaining, installing or leasing or
selling an alarm device or devices or system of alarm devices who desires
to conduct such business in the Village of Scarsdale shall apply to the licensing
authority for a business license on a form to be supplied by the licensing
authority.
B. Alarm agent license. Any person engaged in the business
Of maintaining, repairing, servicing, altering, replacing, removing or installing
an alarm device or system of devices shall carry on his person at all times
while so engaged a valid license and identification card and shall display
such license and identification card to any village official upon request.
Application for such license shall be made to the licensing authority on a
form to be supplied by the licensing authority.
C. Alarm user permit. Any property owner or lessee of property
in the Village of Scarsdale having on such premises an alarm device or system
of alarm devices shall apply to the Scarsdale Police Department for a permit
to own or otherwise have such a device. No such device may be installed on
the premises of the owner or lessee prior to the issuance of a permit to such
owner or lessee. Such permit shall be obtained on an annual basis. All applications
and renewals shall require certification that the device or system of devices
is in good working order and meeting all applicable code requirements within
12 months of the application or renewal.
Permit fees shall be as established by the Village Board, and no refund
of permit fees shall be made.
It shall be unlawful for any person to operate, maintain, modify, install,
lease or sell an alarm device or devices or system of alarm devices without
first obtaining a license/permit as provided in this chapter.
The Scarsdale Police Department may require the denial, suspension or
revocation of any license or permit or the disconnection of any alarm device
in the Village of Scarsdale at any time that the Scarsdale Police Department
deems necessary for the violation of any standards or regulations promulgated
by the Village Manager pursuant to this chapter. Any license, permit or identification
card issued under this chapter shall be surrendered upon a final adverse determination
as provided in this chapter.
No part of a license fee shall be refunded when a license is suspended
or revoked or upon termination of employment.
Any applicant whose application for a license or permit has been denied
or any business licensee, alarm agent, owner or lessee whose license has been
suspended or revoked by the Scarsdale Police Department or any owner or lessee
who is charged for one or more false alarms may contest such denial, suspension,
revocation or charges in writing to the Alarm Review Board within 10 days
after the date of the notice of denial, suspension, revocation or charges.
An appeal may be made in writing to the Village Manager within 10 days of
the Alarm Review Board's determination. The decision of the Village Manager
shall be final.
