Regulations adopted by the Commission shall be construed in accordance with the applicable United States and New York State laws and regulations and any rules and regulations of the Federal Communications Commission ("FCC") and the New York State Public Service Commission ("State Commission") governing the operation of cable television systems.
If any word phrase, sentence, part, section, subsection or other portion of any regulation adopted by the Commission or any application thereof to any person or circumstance is declared void, unconstitutional or invalid for any reason, then such word, phrase, sentence, part, section, subsection, or other portion or the prescribed application thereof shall be severable and the remaining provisions of the regulations and all applications thereof not having been declared void, unconstitutional or invalid shall remain in full force and effect.
As used in this chapter, the following terms shall have the meanings indicated:
CABLE OPERATOR
Any person or party or group of persons or parties who provide(s) cable service over a cable system; or directly or through one or more affiliates owns a significant interest in such cable system; or otherwise controls or is responsible for, through any arrangement, the management and operation of such a cable system.
CABLE SERVICE
Shall be defined as it is defined under § 602 of the Communications Act, 47 U.S.C. 522(6), as amended.
CABLE SYSTEM
Shall be defined as it is defined under § 602 of the Communications Act, 47 U.S.C. 522(7), as amended.
COMMISSION
The Cable Television Commission of the Village of Scarsdale.
PERSON or PARTY
Any individual, corporation, estate, trust, partnership, association of two or more persons having a joint common interest, joint-stock company or governmental entity.
SUBSCRIBER
A person lawfully receiving cable television service.
VILLAGE
The Village of Scarsdale, the government thereof and its territorial limits.
