As used in these Rules and Regulations, the
following terms shall have the meanings indicated:
A pipe in a building or structure which conveys water from
the house (outlet) side of the water meter to plumbing fixtures and
other outlets.
The pipe and its appurtenances from the water main to and
including the curb stopcock or gate valve located between the edge
of the traveled way and the front (street) property line of the premises
being served.
The pipe and its appurtenances from the water service connection
to the street (inlet) side of the water meter of the building served.
Application shall be made in writing at the
office of the Water Department by the property owner or his duly authorized
agent for water service to be furnished by the village. New owners
of property which previously has been furnished water service by the
village shall have no right to the use of water until an application
has been made by such owner, the application has been accepted by
the Water Department and outstanding bills for prior water service,
if any, have been fully paid, inclusive of any penalties.
Water service connections shall be designated "regular" or "special" pursuant to the descriptions set forth in § A320-5A and B.
A.
Regular connections. Regular water service connections
are all such connections other than those described as special service
connections.
B.
Special connections. Special water service connections
are all such connections serving the following purposes:
(1)
All connections serving private fire protection purposes,
including but not limited to hydrants, standpipes and sprinkler systems.
(2)
All connections serving lawn irrigation systems when,
as determined by the Water Department, the water demand requires such
special connection.
(3)
All connections serving nonrecirculating, watercooled
refrigeration units for air-conditioning or other purpose when, as
determined by the Water Department the water demand requires such
special connection.
No more than one water service connection shall
be permitted for each building or group of buildings on a single property,
except that the Water Department may permit or may require one or
more additional water service connections if, in its judgment, physical
conditions or water demand so require. The property owner shall pay
additional fees, pursuant to the requirements of these Rules and Regulations,
for such additional connections.
The property owner of the premises being served
shall pay, in advance, such water service connection fees as are established
by the Board of Trustees. For payment of such fee, the Water Department
will tap the water (street) main, install the corporation cock and
will furnish, for installation by the owner, the curb stopcock and
curb box. The Water Department will also furnish for the payment of
such fee, for installation by the owner, the meter-setting device
for meters not larger than one inch.
A.
Connections for fire protection purposes. Subject
to a determination by the Water Department regarding the need and
advisability of such connection, permission may be granted by the
Water Department for a special water service connection for private
fire protection purposes. Such determination will be based upon, but
not limited to, consideration of the size of the available water main,
the availability of fire hydrants and the possible effect upon the
water main system if such service were broken and open during a fire
emergency.
(1)
Connections for fire protection sprinkler systems
for other than one- and two-family dwellings shall be separate from
the main potable water supply to the premises and separately metered.
In one- and two-family dwellings, a sprinkler system connection may
be made, with permission from the Water Department, directly from
the main potable water supply to the premises.
(2)
Applications for such special water service connection
shall be made to the Water Department and shall be accompanied by
drawings showing all pumps, tanks, valves, piping, backflow-prevention
devices, connections and other appurtenances proposed for installation.
(3)
The size of such connection shall be determined by
the Water Department, but in no event shall it be larger than six
inches.
(4)
The cost of such connection, which shall include an
approved backflow-prevention device, when such is required, with meter
on a bypass and such pit or vault as may be required, shall be borne
by the property owner.
(5)
The property owner shall pay an annual ready-to-serve
charge based upon the size of such connection. Such charge shall be
established by the Board of Trustees.
(6)
A special water service connection for private fire
protection purposes shall be used exclusively for such purpose. Cross-connections
between such service and water service provided for any other purposes
is prohibited.
(7)
Other than as set forth in this section, such connections
shall be subject to all rules and regulations applicable to regular
water service connections.
B.
Connections for lawn irrigation purposes. The use
of water from the village water system for purposes of lawn irrigation
is prohibited without specific approval therefor from the Water Department.
Approval by the Water Department shall be based upon, but not limited
to, the details of the proposed installation and the effect of such
use upon water service to neighboring properties during periods of
peak demand.
(1)
Applications for such connections shall be made to
the Water Department.
(2)
Applications shall be accompanied by drawings showing
the layout of the irrigation system, including all valves, connections
and other appurtenances. Such drawings shall bear the approval of
the Westchester County Department of Health.
(3)
The Water Department, when approving such applications,
shall determine whether a special water service connection is required.
C.
Connections for refrigeration units. The use of water
from the village water system for the purpose of serving nonrecirculating
water-cooled refrigeration units with a rated capacity exceeding three
tons (864,000 Btu's) is prohibited without specific approval therefor
from the Water Department.
(1)
Applications for such connections shall be made to
the Water Department.
(2)
Applications shall be accompanied by drawings showing
complete details of the proposed installation.
(3)
The Water Department, when approving such applications,
shall determine whether a special water service connection is required.
D.
Further conditions of service. In the granting of
an application for water service connections, the Water Department
may impose such additional conditions and safeguards as are deemed
necessary for the protection of the health and welfare of recipients
of the water service or the integrity of the water system.
For those premises within the corporate limits
of the village and Eastchester Water District No. 1 receiving water
service from the village, the Water Department will, at no cost to
the property owner, maintain, repair or renew water service connections
not larger than two inches, except as hereinafter set forth.
A.
Property owner's responsibility. The property owner
of the premises served shall bear the cost of:
(1)
The maintenance and repair of water service connections
larger than two inches.
(2)
The maintenance and repair of water service connections
to premises outside the corporate limits of the village or Eastchester
Water District No. 1.
(3)
The subsequent installation of a larger water service
connection than originally installed should the latter be deemed inadequate
by the Water Department because of increased demand to the premises
served.
(4)
The repair or replacement of covered or broken curb
boxes when such damage has been caused by other than the village work
force or equipment.
B.
Enlarging or replacing connections. If a property
owner requests an enlarged or replaced water service connection because
of insufficient pressure or other reason, he shall, at his expense,
first replace the water service pipe with pipes and fittings of a
size approved by the Water Department. If then, in the judgment of
the Water Department, the water pressure or other problem may be resolved
by replacement of the water service connection, the Water Department
will perform such replacement.
C.
Service connections outside of Water Department area.
Water service connections serving premises located outside the corporate
limits of the village and outside the established boundaries of the
Eastchester Water District shall be maintained, repaired or replaced
to the extent required by the Water Department by the owner of the
premises served.
Except for the water main tap and the corporation
cock, street service connections shall be installed by the property
owner, who shall obtain the required street opening permit and who
shall provide the necessary piping of approved size and material,
the installation of such piping, including all trenching, backfilling
and repaving incidental to the work. Trench backfilling shall not
be undertaken until the installation has been inspected and approved
by a Water Department representative.
A.
Laying water service pipe. All water service pipes
shall be laid in a separate trench and on undisturbed soil at least
three feet distant horizontally from all other underground facilities.
The placing of water service pipes in the same trench as that occupied
by sanitary or storm sewers, gas lines or other utilities is prohibited
except in extraordinary circumstances and with written approval of
the Water Department.
B.
Depth of water service pipe. All water service pipes
shall be installed no less than four feet below the finished grade
at all points and no less than four feet horizontally from any open
excavation or vault. Such conditions shall be maintained as long as
the water service pipe is in use.
C.
Alignment of water service pipe. All water service
pipes shall be laid in a straight line from the water main to the
building being served and shall be laid perpendicular to the front
(street) property line. Where, for reasons deemed adequate by the
Water Department, such a layout is not feasible, such Department may
grant permission for an alternative layout. If such permission is
granted, the owner shall furnish to the Water Department a plan certified
by a professional engineer or licensed land surveyor showing the location
of the service pipe as installed and with dimensions to an adequate
number of fixed points to permit relocation in the future.
D.
Owner's responsibility for water service pipe. The
owner shall maintain and renew, when necessary, all water service
pipes from the outlet side of the curb stopcock. Upon a determination,
notice and order from the Water Department that a water service pipe
requires repair or replacement, the owner shall make such required
repairs or replacement. If the owner shall fail to initiate such repair
or replacement within three days of said notice, water supply to the
premises may be discontinued until such repair or replacement has
been completed and approved by the Water Department. Repairs to the
water service pipe shall be left exposed until inspected and approved,
while under pressure, by the Plumbing Inspector or the Water Department
representative.
E.
Water service pipe materials. Piping and pipe appurtenances
for water service connections shall be either copper pipe, copper
water tube Type K, red brass with a minimum of 85% copper or cement-lined
cast iron.
