The village shall not be liable for any loss or damage to private property or to any public property not owned by the Village of Scarsdale because of variation in the amount or consistency of the pressure or volume of the water supplied or because of water escaping from, obstructions in or frost action upon water service pipes or because of water escaping from water distribution pipes, laterals, appliances or fixtures which are privately owned.
The Water Department shall exercise sole control, except as set forth in § A320-22, including the operation, maintenance and replacement, where necessary, of all water mains, valves, hydrants, curb stopcocks, water service connections, valve boxes, meters and other appurtenances connected or associated with the water supply system, located in any public way, easement or village-owned property within the village boundaries.
A. 
Any person willfully interfering with the operation of any water system facilities shall be in violation of these Rules and Regulations and subject to the provisions of § A320-2.
B. 
The Water Superintendent shall have the authority to institute the appropriate proceedings at law against those suspected of being in violation of these Rules and Regulations and to require the removal or termination of any violation.
The Board of Trustees may curtail the amount of water supplied and may curtail the use of water in the event of a shortage of water being supplied to the village.
A. 
Curtailment for system maintenance. The Water Department shall have the right to curtail the use of water on a temporary basis, within such area as may be affected by a shortage of water because of work being performed on the water supply system.
B. 
Curtailment of lawn sprinkling. In case of a shortage of water, the Water Department shall have the right to limit or prohibit the use of water for sprinkling of lawns or gardens or for any purpose not deemed necessary for the maintenance of public health.
C. 
Compliance with water curtailment. When the supply or use of water has been curtailed, if water is used wastefully or negligently on a consumer's premises, seriously affecting the general water service, the Water Department may discontinue the service to such premises if conditions are not corrected within 24 hours after giving the consumer written notice, or, if no emergency exists, it may discontinue service at once without notice.
No person shall supply water to either persons or premises other than such premises for which the initial water service was originally supplied unless specific permission for a temporary reallocation has been received from the Water Department. During a period of emergency, the Water Department is authorized to require and make any necessary provisions for the supply of water to a given premises being reallocated in part to service another. In such case, the Water Department will make proper credit for the excess water consumption as recorded on the water meter of the primary receiver of water service.
No person shall perform work on piping or other elements attached to the village water supply system unless such person is in possession of a current master plumber's license issued pursuant to § 132-40 of the Code of the Village of Scarsdale.
Persons engaging in underground excavation, whether by hand or by machine, for any purpose shall be responsible for determining the location of all elements of the village water supply system in the immediate vicinity of such excavation and for maintaining in position all water mains, water service connections and other elements of the system in such vicinity. When, due to such excavation, damage is caused to any element of the village water supply system, the person responsible for such damage shall immediately notify the Water Department, shall cause such damage to be repaired immediately at his expense and shall reimburse the Water Department for the cost of any services required by such Department for temporary or permanent restoration required because of the damage incurred.
The village will use reasonable care to furnish good, wholesome water, but, in case the water furnished by it is taken from the water system of the City of New York or of any other municipality or any water company whose supply is under the supervision of the State Board of Health of the State of New York, the village shall not be liable for damages due to the quality thereof, unless it shall have official notice of deficiencies therein and shall fail within a reasonable time to correct the same or to publish in an official village newspaper a warning against the use thereof for domestic purposes. The village shall not be liable for inconvenience or damage resulting from water of high color or carrying suspended matter.
No person owning or occupying premises receiving water service from the village shall make, or allow to be made, any connection, either of a direct or of an indirect nature, between his piping system and a water supply from any other source or install, or allow to be installed, any fixture or appliance or waste or soil pipe from which water may flow, be syphoned or be pumped into any piping connected to the village water system.
A. 
All service lines from the village water supply system shall be protected from backflow of water by means of an approved backflow prevention device to prevent contamination from the premises into the village water supply system.
B. 
Each service line to a facility shall be protected in a manner commensurate with the degree of hazard of the facility. The degree of hazard and type of backflow prevention device to be used to achieve containment shall be based on use of the facility and availability of contaminants.
C. 
The Water Department shall determine the type of backflow prevention device to be installed based upon their determination of the degree of actual or potential hazard. When required, the design of backflow prevention device installations shall be approved by the Westchester County Department of Health.
D. 
All backflow prevention devices used must be on the current listing of acceptable devices issued by New York State Department of Health.
E. 
Unless otherwise specified, backflow prevention devices shall be installed close to the house side of the water meter.
F. 
All backflow prevention devices shall be furnished, installed, tested, protected and maintained by the property owner at his own expense.
In cases where boilers or other appliances in a premises depend upon the pressure in the service line to keep them supplied with water, the owner or occupant shall place suitable safety devices to guard against the possibility of collapse or explosion when the water supply is interrupted. Likewise, such owner or occupant shall protect water-cooled compressors for refrigeration systems by means of high-pressure safety cutout devices and shall provide means for the prevention of the transmission of water hammer or noise of operation of any valve or appliance through his piping to any adjacent premises. Failure of the owner or occupant to provide such safety devices shall in no way make the village responsible for any resulting damage.
