A certain document, a copy of which is on file in the Office of Code Enforcement for the Borough of Downingtown, being marked and designated as "International Property Maintenance Code, 2009 Edition," as published by the International Code Council, and amended from time to time, is hereby adopted as the Property Maintenance Code of the Borough of Downingtown, in the Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings, and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Borough of Downingtown are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 222-2 of this chapter.
The International Property Maintenance Code, 2009 Edition, is amended and revised in the following respects:
In Section PM-101.1, insert "the Borough of Downingtown."
Section PM-106.4 is changed to add the following sentence: "Violations of the International Property Maintenance Code, 2009 Edition, shall be subject to a fine not to exceed $1,000 or imprisonment for a term not to exceed 30 days, or both, at the discretion of the court."
Sections PM-111.1 through PM-111.8 shall be deleted in their entirety and replaced with the following:
111.1. Appeals. Any person shall have the right to appeal a decision of the Code Official and said appeal shall be heard by the Borough's Board of Administrative Appeals in accordance with the provisions of Chapter 4 of the Code of the Borough of Downingtown.
In Section PM-304.14, insert "March 1 to November 1."
Section PM-302.8 is changed to replace the phrase "inoperative or unlicensed motor vehicle" with "unregistered or uninspected vehicle" and replace the "exception" as follows:
Exception: A vehicle classified and licensed as an antique or classic vehicle, in accordance with commonwealth standards, may be permitted to be parked, kept or stored on a premises for a time period not to exceed six months.
In Section PM-602.3, insert "September 15 to April 15."
In Section PM-602.4, insert "September 15 to April 15."
