Pursuant to the provisions of N.J.S.A. 40A:9-140,
the position of Township Engineer is hereby established in the Township
of South Hackensack.

The Township Engineer shall be a licensed engineer
in the State of New Jersey and shall maintain the same in good standing
during the course of his appointment. The Township Engineer shall
be appointed by the Township Committee and shall hold office for a
term of up to three years beginning on the date of said appointment
and terminating on December 31 or the appointment of a qualified successor.
The Township Engineer shall:
A. Provide professional engineering advice and assistance
to the Township Committee.
B. Prepare plans and specifications for public works
authorized by the Township Committee.
C. Make such inspections of the work of public contracts
as may be necessary or advisable.
D. Supervise the performance of public work contracts
and certify the amounts dues and payable thereunder.
E. Maintain the Township Official Map and the Township
Zoning Map.
F. Provide any and all other professional engineering
advice and assistance as may be required of him or her by statute
or as requested of him or her by the Township Committee, whether by
ordinance, resolution or otherwise.

The Township Engineer shall receive from the
Township a retainer set forth by contract and established by the Salary
Ordinance. In addition, he or she shall receive fees for services
rendered by him or her to the Township Committee in accordance with
the normal and customary professional fees charged by licensed engineers
within the state and established by contract. The Township Engineer
shall also receive fees from applicants and developers who are required
by ordinance and/or law to establish a developer’s escrow with
the Township. All charges and fees shall be paid only upon submission
of an itemized invoice for service and approval of a voucher submitted
therewith. Within 30 days of the conclusion of each year, the Township
Engineer shall make a written report to the Township Committee, which
shall include the total amount of fees collected during said term
of appointment and detail any outstanding charges and fees due and
owing.
The adoption of this article shall not affect
any acts of the Township Engineer which were performed by him or her
prior to the adoption of this article, provided that such acts were
properly performed in accordance with applicable law.
