The title of this article is: "Ordinance Prohibiting
the Use of Firearms, Bows, Compound Bows, Arrows, or Crossbows to
Kill Elk in Buchanan County, Virginia."
The killing of elk in Buchanan County, Virginia
is prohibited by the use of any type of firearms, including muzzle-loaded
weapons, bows, compound bows, arrows, or crossbows as set forth in
Sections 29.1-528, 29.1-519 and 15.2-916 of the Code of Virginia.
Violation of this article shall be punishable
as a Class 3 misdemeanor, and any person found guilty of a violation
of this article shall, in addition to the foregoing penalty, forfeit
such animal and future hunting privileges provided for by applicable
Virginia statute and related regulations as promulgated by the Virginia
Department of Game and Inland Fisheries, which are hereby adopted
by reference.
Any person owning land in Buchanan County who
sustains elk-related damages to commercial crops or orchards may petition
the governing body of Buchanan County for a variance to this article
to allow the killing of elk upon the landowner's property during regular
deer season, or the governing body may, at its option, choose to relocate
the elk or mitigate future damages by constructing elk-resistant fencing
around the landowner's crops, orchard or hay storage area.
