Industrial users shall provide necessary wastewater treatment as required to comply with this chapter and shall achieve compliance with all categorical pretreatment standards, local limits and the prohibitions set out in §
73-12 above within the time limitations specified by the EPA, the applicable state or the Executive Director, whichever is more stringent. Any facilities required to pretreat wastewater to a level acceptable to the PSA shall be provided, operated and maintained at the industrial user's expense. Detailed plans showing the pretreatment facilities and operating procedures shall be submitted to the PSA for review and shall be acceptable to the PSA before construction of the facility. The review of such plans and operating procedures will in no way relieve the industrial user from the responsibility of modifying the facility as necessary to produce an acceptable discharge to the PSA under the provisions of this chapter.
The PSA may adopt reasonable charges and fees for reimbursement of costs
of setting up and operating the PSA's pretreatment program, which may
include:
A. Fees for wastewater discharge permit applications, including
the cost of processing such applications.
B. Fees for monitoring, inspection and surveillance procedures,
including the cost of collection and analyzing an industrial user's discharge
and reviewing monitoring reports submitted by industrial users.
C. Fees for reviewing and responding to accidental discharge
procedures and construction.
E. Other fees as the PSA may deem necessary to carry out
the requirements contained herein. These fees relate solely to the matters
covered by this chapter and are separate from all other fees, fines and penalties
chargeable by the PSA.
