This article shall be known as the "Trash Pickup Law of the Village of Airmont."
It is the intention of the Village Board of the Village of Airmont by the adoption of this article to protect the health, safety and welfare of the residents of the Village of Airmont by establishing procedures and requirements for the pickup of trash and recyclables.
A. 
For the purposes of this article, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words in the present tense shall include the future, words in the plural number include the single number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
B. 
As used in this article, the following words shall have the meanings indicated:
DESIGNATED RECYCLABLE
Shall be held to mean those items which the Mayor has designated from time to time as items for mandatory recycling within the Village of Airmont, or any item required by any federal, state or local law to be recycled, including, but not limited to, those recyclables defined and regulated in Article II, Recycling, of this Chapter 172 of the Code of the Village of Airmont.

PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
TRASH
(1) 
Shall be held to mean the following:
(a) 
Any item of solid waste not encompassed within the definition herein of garbage, that is nontoxic and is placed in a clearly fastened container or bag which is filled at a maximum weight of 60 pounds and a maximum volume capacity of 30 gallons. Said items include discardable household items of a durable nature; garden, yard and lawn waste such as grass clippings, leaves and tree branches; ashes and other refuse resulting from the burning of wood and/or coal for heating purposes. NOTE: Refuse from demolished or newly constructed buildings, materials left over from home improvements and remodeling projects relating to existing residences, such as lumber, paneling, rolled insulation, wiring, pipes, plaster, concrete and bricks, are not considered as trash.
(b) 
Discardable household items of a durable nature, such as carpeting, furniture and household appliances, e.g., refrigerators, washing machines, dryers, dishwashers, hot-water heaters and window air conditioners.
(c) 
Trees and tree branches, provided the same are cut into sections less than four feet in length with each section weighing not more than 60 pounds.
(d) 
Large motor vehicle parts up to 60 pounds and tires, except for junk vehicles, vehicle bodies, engine blocks, transmissions or motors.
(2) 
Notwithstanding any other provisions, the term "trash" shall not include any designated recyclables.

For collection pursuant to a schedule announced by the Village of Airmont, all trash must be placed on the curbline where accessible. Such trash shall be set out no earlier than 3:00 p.m. on the day prior to collection, and all containers shall be removed no later than 9:00 p.m. on the collection day. When a regular collection day falls on a legal holiday, containers shall not be set out until the next regularly scheduled collection day unless special announcement of collection is made by the Village.

The Police Department of the Town of Ramapo, the Village Board of Trustees, and/or the Code Enforcement Officer or Building Inspector of the Village of Airmont shall have the right and authority to issue an appearance ticket, as the same is defined in Article 150 of the Criminal Procedure Law of the State of New York, for the violation of any section of this article except that, for the first violation, a written warning shall be issued in lieu of an appearance ticket.

A. 
Any person violating any section or provision of this article shall be punishable by a maximum fine of $250 or a maximum term of imprisonment of 15 days, or both.
B. 
In the case of continuing violation of this article, each day that such violation exists shall constitute a separate and distinct offense.
