A. 
It has come to the attention of the Board of Trustees of the Village of Babylon, and said Board of Trustees finds and declares, that many residential areas in Babylon are inundated with the parking of vehicles owned by nonarea residents. Those nonresidents who park in such areas include:
(1) 
People who are employed in business and commercial areas abutting residential areas.
(2) 
Individuals who use parks, docks or other public facilities within or abutting residential areas.
(3) 
Individuals who use restaurant, business, commercial and boating facilities within or abutting residential areas.
B. 
The Board of Trustees finds and declares that the provisions of this article are enacted for the following reasons:
(1) 
To reduce the hazardous traffic conditions that are caused by the use of streets within residential areas by vehicles operated and parked by persons not residing within the residential area.
(2) 
To protect those residential areas from polluted air, excessive noise and refuse caused by the entry of such vehicles.
(3) 
To protect the residents of these residential areas from unreasonable burdens in gaining access to their residences and in the quiet enjoyment of their homes.
(4) 
To preserve the character of those areas as residential areas.
(5) 
To preserve the value of the property in these residential areas.
(6) 
To promote traffic safety and the safety of pedestrians in those traffic areas.
(7) 
To forestall damages arising from the blocking of fire lanes, hydrants and other facilities required by emergency vehicles, both in reaching victims and in transporting them to hospitals.
(8) 
To facilitate the movement of traffic in the event of accidents and other disasters.
(9) 
To promote the peace, comfort, convenience and welfare of all inhabitants of the Village of Babylon.
As used in this article, the following terms shall have the meanings indicated:
AREA RESIDENT
The owner or owners or tenant or tenants of or in a dwelling whose mailing address fronts upon a residential area, as hereinafter defined, and commercial owners and commercial tenants of properties whose mailing address fronts upon a residential area.
HIGHWAY SUPERINTENDENT
The Superintendent of the Highways for the Village of Babylon.
PERMIT
A decal or sticker issued by the Village Clerk to an area resident in a residential area to be affixed to the resident's automobile.
RESIDENTIAL AREA
An area which the Board of Trustees of the Village of Babylon has designated or protected.
VILLAGE CLERK
The Clerk of the Village of Babylon.
A. 
Where the Board of Trustees, upon the advice and findings of the Highway Superintendent, determines that parking in a specific residential area should be restricted to area residents only, it shall cause a notice of that determination, including a designation of the streets within said area to be published in the official newspaper of the Village, and it shall cause signs denoting said area to be erected thereon. Effective 10 days after publication and upon the erection of signs denoting the area and reciting the restriction, it shall be unlawful for anyone other than an area resident to whom a permit has been issued to park or to allow a vehicle to be parked along a street which has been designated for residential parking only.
B. 
Anyone, other than an area resident to whom a permit has been issued, who parks in a restricted area shall be subject to a fine of $50 in addition to any other provision for enforcement
C. 
The provisions of this section shall not apply to vehicles parked temporarily in order to provide goods or services to area residents.
D. 
Nothing contained in this article shall be deemed to prohibit the issuance of visitor parking permits valid for limited periods of time.
E. 
The Board of Trustees may limit the period when resident parking shall be in effect.
A. 
Upon the receipt of a written request from residents of a restricted area claiming that the area should have residential parking permit only, the Board of Trustees shall cause the Highway Superintendent to investigate said request. Upon investigation, the Highway Superintendent shall transmit his advice to the Board of Trustees, which shall thereafter determine if parking should be restricted in said area.
B. 
The advice of the Highway Superintendent shall be based upon his opinion as to what effect said restriction shall have upon traffic in the area as well as whether or not the health, welfare and safety of area residents require it.
C. 
The determination of the Board of Trustees shall be based upon the advice of the Highway Superintendent as well as its own judgment as to the effect of the restriction upon the entire Village. Before the Board makes such a determination, an official notice of a public hearing shall be published in the official newspaper of the Village.
Up to two visitors' parking permits per household may be issued to any resident of a residential parking permit area who meets the following requirements:
A. 
The resident owns a vehicle which qualifies for a residential parking permit, provided that no other person in the same household has been issued more than one visitor's parking permit.
B. 
In a household where the resident(s) do not hold a residential parking permit upon fulfillment of requirements designated by the Board of Trustees, provided that no other person in the same household has been issued more than one visitor's permit.
Handicapped persons and severely disabled persons who have obtained a permit or registration issued under § 404-a or 1203-a of the New York Vehicle and Traffic Law of the State of New York shall be exempt from the provision of this article.
A. 
The Board of Trustees shall establish rules and regulations relating to the use of residential parking permits and visitor passes and may suspend both resident parking permit privileges and visitors' pass privileges for a period not to exceed 12 months for violation of said rules and regulations.
B. 
No such suspension shall be effective unless the Board of Trustees has given the permit holder at least 10 days' written notice of the charge against the holder and afforded the holder an opportunity to be heard on such charges.
C. 
The Board of Trustees may implement any ticket-writing effort by creating a towing and immobilization program along with the employment of a civilian ticket-writing corps.
D. 
Any holder of a residential parking permit or visitor's permit who allows such permit to be used by a person or persons other than the permit holder, or a member of his family residing in the same household, or a person or persons actually visiting the house of said residential permit holder, shall be subject to a fine up to $250 and suspension of permit parking privilege up to 12 months. The provision of Subsection B above shall also apply to this subsection.
A. 
Upon a determination of the Board of Trustees that parking in a residential area shall be restricted to area residents and upon the publication of said determination and the posting of signs, the Village Clerk shall issue a permit to an area resident applying for it, together with two visitors' permits which shall lapse on the same date as the resident permit. The application and permits shall be in such form as the Village Clerk determines. Said Village Clerk may require any proof of residency he determines necessary before issuing a permit.
B. 
Any permit issued shall be valid for the specific area the Board of Trustees has determined to be restricted.
C. 
The fee for any permit issued shall be set by resolution of the Board of Trustees, which sum shall be payable at the time of issuance, and said permit shall expire the first day of each year thereafter.
D. 
Area residents who conduct a professional practice from their premises may apply to the Village Clerk for professional privilege stickers. No more than six such permits shall be issued to such professional individuals per year, at a charge to be set by resolution of the Board of Trustees. Lost, stolen, destroyed or missing permits may be replaced with an additional charge as specified by resolution of the Board of Trustees.
