It shall be unlawful to install or use gas heating apparatus for domestic, industrial or commercial heating purposes in the City except in compliance with the Plumbing and Building Codes[1] and the provisions of this article. Service and installation must be made by a registered plumber licensed by the City.

A. 
For the purpose of this article, "gas-fired appliances, gas-fired boilers, furnaces, space heaters and unit heaters" shall mean any appliance, boiler, furnace, unit heater or space heater supplying heat and using gas as a fuel.
B. 
For the purpose of this article, "gas-fired boilers, furnaces, space heaters, unit heaters and appliances" shall mean any appliance, boiler, furnace, space heater or unit heater having a device or so-called burner of any kind whereby the use of gas as a fuel is attached thereto as specified in Subsection A of this section.
A. 
The Commissioner of Buildings shall be the examiner, empowered to pass upon all plans which must be submitted prior to the installation of any gas burner or device or its adjuncts.
B. 
It shall be unlawful for any person, firm or corporation or its agents governed by this article to install any gas burner or device unless an application in the following form is on file with the Building Department before an installation is made and a certificate of approval shall have been issued.
C. 
Application for certificate of approval shall be in the following form:
(1) 
Name of burner or boiler.
(2) 
Name of manufacturer.
(3) 
Address of manufacturer.
(4) 
Kind of gas and pressure required for burner.
(5) 
Number of years burner has been on the market.
(6) 
List of laboratories, states and cities approving same. If approved by the American Gas Association, give listing.
(7) 
Attach blueprint of assembly.
(8) 
Attach set of specifications and drawings to show construction of device.

The Commissioner of Buildings will issue a certificate of approval or disapproval according to the provisions of these regulations. The test of the Commissioner of Buildings shall cover arrangement of parts, electrical control, thermostatic arrangement, reliability of automatic features, positiveness of ignition and safeguards against flooding or other defects. Wherever the gas burner or device has been duly approved by the American Gas Association, the Commissioner of Buildings may dispense with such test and issue a certificate of approval for such equipment.
E. 
With the certificate of disapproval, the Commissioner of Buildings will issue to the applicant and to the manufacturer of the device a clear and concise statement as to the reason or reasons for disapproval.
F. 
New application after disapproval shall not be made until 30 days from the date of issue of certificate of disapproval.
G. 
Any new applications after disapproval shall be accompanied by a clear and concise statement giving reasons for reconsideration, based on information received with the certificate of disapproval.
H. 
Each manufacturer, in order to install gas-fired boilers or furnaces, must register his equipment with the Commissioner of Buildings. This approval will cover all equipment of the manufacturer, provided that all such equipment has been approved and listed by the American Gas Association or the local gas utility.
A. 
These regulations are intended for application to each heating boiler, furnace, space heater, unit heater and appliance used for domestic, industrial or commercial purposes.
B. 
No gas appliance as described in § 96-12A for heating a building shall be installed and no boiler or furnace designed for other fuels shall be converted to the use of gas fuel unless approved by the Commissioner of Buildings and the American Gas Association.
All applications for installation of gas-fired appliances, boilers, furnaces, space heaters, unit heaters, their auxiliaries, burners and other devices shall be made to the Commissioner of Buildings, giving the following information:
A. 
Name and address of applicant.
B. 
Location where gas-burning equipment is to be installed.
C. 
Maximum pressure, BTU input.
D. 
Name of burner and by whom manufactured.
E. 
Name of concern making the installation; license number.
F. 
Location of buildings or building where burners or burner are located and nature of construction, dimensions of buildings and purposes for which used.
A. 
No gas-burning equipment except that which has been approved by the Commissioner of Buildings shall be installed in the City. No gas-burning apparatus may be used until it shall have been inspected and approved by the Superintendent of Plumbing.
B. 
Application for such inspection shall be in writing on a form furnished by the Commissioner of Buildings, and a fee of $5 for each inspection shall accompany the application.
C. 
A permit issued pursuant to these regulations shall at all times be subject to inspection by the Superintendent of Plumbing.
D. 
The Commissioner of Buildings may at any time modify, suspend or revoke any such permit upon certification to him by the Superintendent of Plumbing of the Building Department.
A. 
Whenever an installation is made, it will be necessary that a full-size shutoff valve be located in a suitable curb box located at the front of the building near the curb, fully exposed and readily accessible for Fire Department use.
B. 
All gas appliances shall be provided with a manual shutoff valve ahead of all controls, including the pilot gas valve. A union connection shall be provided downstream from the manual main shutoff valve to permit removal of the controls.
C. 
A thermostatic pilot light shall be used, so constructed and adjusted that no gas can flow thorough the main burner unless the pilot light is burning.
D. 
The boiler or furnace shall be equipped with safety devices arranged to shut off the main burners in case of high steam pressure or low water (or high temperature) for steam or vacuum vapor boilers or of high temperature for warm-air furnaces. No devices employing or depending upon an electrical current shall be used to control or ignite a gas supply if of such a character that failure of the electrical current could result in the escape of unburned gas or in failure to reduce the supply of gas under conditions which would normally result in its reduction unless other means are provided to prevent the development of dangerous temperatures, pressures or the escape of gas.
E. 
All installations of gas heating equipment in steam plants of both high and low pressure shall be equipped with low-water cutoff approved by the Commissioner of Buildings.
F. 
An approved gas pressure regulator of sufficient size shall be installed in the gas line leading to the appliance and properly vented in accordance with the manufacturer's instructions.
G. 
All gas appliances, boilers, furnaces, space heaters and unit heaters must be installed in accordance with the standards as approved by the National Board of Fire Underwriters, Code No. 54, Installation of Gas Piping and Gas Appliances in Buildings.
All piping shall be installed in compliance with the provisions set down by the National Board of Fire Underwriters, Code No. 54; the American Gas Association, as revised 1955; and the Plumbing and Building Codes[1] of the City of Mount Vernon, New York, or other duly adopted rules or regulations of the City.

All outside gas piping shall be done in accordance with the rules and regulations as approved by the American Gas Association and the local gas utility.
No gas-fired boilers or furnaces shall be installed in a room in which the facilities and ventilation do not permit the proper combustion of the gas under normal conditions of use. Permanent openings must be made to provide an adequate supply of air for small enclosed boiler rooms.
When installing gas-fired boilers or furnaces, the pilot gas supply shall be connected so that the pilot can be lighted while the main burner is turned off by a manually operated valve.
As part of each burner installation, there shall be installed a remote control switch labeled "gas burner" whereby the electric current may be, in an emergency, controlled by members of the Fire Department. Such switch shall be located in a readily accessible location such as the nearest inside entrance to the cellar, preferably in the cellar stairway door.
Electrical current wiring and equipment in connection with gas-burning equipment shall be installed in accordance with the National Electrical Code or other duly adopted rules or ordinances of the City.
