[HISTORY: Adopted by the Council of the City of Mount Vernon 11-13-1957 as Ch. 48 of the General Ordinances, approved 11-15-1957. Amendments noted where applicable.]
The legal holiday known as "Memorial Day" being by general consent, custom and tradition set apart for rest, repose and patriotic observances and uses, and the observance thereof being for the solemn tribute by the community to our honored war dead, the doing of certain acts hereinafter specified, which are deemed serious interruptions and desecrations of this holiday, is prohibited.

All labor, manufactures and trades on such holiday are prohibited between the hours of 8:00 a.m. and 12:00 noon excepting the works of necessity and charity, which include whatever is needful during the holiday for the good order, health or comfort of the community and which are performed in orderly manner so as not to interfere with the rest, repose and patriotic observances of the community. Nothing herein contained shall be deemed to prohibit public or private sports, exercises, games, recreation, concerts, dances, shows, entertainments or performances, nor any necessary labor involved in such activities.

A. 
All manner of public selling or offering for sale of any property upon such holidays is prohibited between the hours of 8:00 a.m. and 12:00 noon except as follows:
(1) 
Meals may be sold to be eaten on the premises where sold at any time of the day.
(2) 
Caterers may serve meals to their patrons at any time of the day.
(3) 
Prepared tobacco, bread, milk, dairy products, eggs, ice, soda water, ice cream, fruit, cooked and prepared foods, flowers, confectionery, newspapers, magazines, gasoline, oil, tires, drugs, medicine and surgical instruments may be sold and may be delivered at any time of the day.
B. 
The provisions of this section shall not be construed to allow or permit the public sale or exposing for sale or delivery of uncooked fresh foods or meats, fresh or salt, at any hour or time of the day; nor shall the provisions of this section be construed to prevent or prohibit the sale of beverages not expressly prohibited by law or by rules adopted by the Alcoholic Beverage Control Law.
A violation of the prohibition herein specified is an offense punishable by a fine of not less than $10 and not more than $25 or by imprisonment not exceeding five days, or by both; but for a second or other offense where the party shall have been previously convicted, it shall be punishable by a fine of not less than $25 and not more than $50 or by imprisonment of not less than five nor more than 20 days, or both.
