As used in this chapter, the following terms shall have the meanings indicated:
MAN-MADE MATERIAL
Any item or object which is not a structure and which is manufactured, processed, produced or otherwise created by man, regardless of its form, value or utility. Included herein are "municipal waste" and "residual waste" as defined by the Pennsylvania Solid Waste Management Act, 1980, July 7, P.L. 380, No. 97 § 103 (35 P.S. § 6018.103), which definitions are incorporated herein by reference as though more fully set forth at length.
OUTSIDE STORAGE
The storage of any man-made material outside of a completely enclosed and roofed structure.
STORAGE
The containment, maintenance or location of any man-made material for a period in excess of 30 days in such a manner as not to constitute disposal of the same as defined by the Pennsylvania Solid Waste Management Act, 1980, July 7, P.L. 380, No. 97, Section 103 (35 P.S. § 6018.103) which definitions are incorporated herein by reference as though more fully set forth at length.
WRITTEN OR ACTUAL NOTICE
Written notice delivered by certified mail, return receipt requested, actual personal service or written notice upon the alleged violator or a designated agent, or the conspicuous posting of written notice at the offending site.
It shall be unlawful for any person or entity within the Township of Bern to cause or permit the outside storage of any man-made material as defined herein.
An owner or occupier, upon receipt of written or actual notice from a Bern Township police officer or the Bern Township Zoning Officer of an alleged violation hereof, shall correct and remove the offending condition within five days or shall be deemed to be in violation of this chapter.
Farm equipment and implements of animal husbandry which are part of a continuous and operating agricultural business enterprise are exempt from the provisions thereof.
This chapter shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person who violates or permits the violation of this chapter shall, upon conviction in a summary proceeding, be punishable by a fine of not more than $1,000 or by imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues, or is permitted to continue, shall constitute a separate offense. Each section of this chapter that is violated shall also constitute a separate offense.
