Pursuant to Article XXIV § 2401(c)(3)
of the Second Class Township Code, the Supervisors of Richland Township
hereby authorize the installation of curbing within the Township as
follows:
A. All curbing shall be installed to Township specifications
by the Supervisors of Richland Township pursuant to Article XXIV § 2401(c)(3)
in such locations as designated by the Board of Supervisors.
B. Payment for such curbing shall be assessed against
the abutted property owners in proportion to their frontage; provided,
however, that no property owner shall be liable for the cost of construction
of the curb in an amount greater than 15% of the assessed valuation
of the abutting property. Any expense above the maximum liability
of abutting property owners shall be paid by the Township.
C. Assessments pursuant to Subsection
B may be paid as follows:
(1) The first payment shall not be due until 90 days from the notice of completion of the installation of curbing adjacent to the owner's property. Prior to the first payment, the landowner shall elect the payment method from the options set forth in Subsection
C(2). Those electing an installment method shall enter into an appropriate agreement, and a municipal claim for the appropriate amount shall be filed as set forth in § 3303(b) et seq., of the Second Class Township Code.
(2) The amount due may be paid as follows:
(a)
If the amount is paid in full within the ninety-day
period, there will be a five-percent discount.
(b)
The owner may pay the sum in 36 equal monthly
payments with no interest (other than statutory interest for late
payments).
(c)
The owner may pay the sum in 60 equal monthly
payments with interest not to exceed 6%.
D. Any person who contests any assessment approved by
any other matter hereunder shall be entitled to a hearing on same
pursuant to the Local Agency Law (2 Pa.C.S.A. § 105 et seq.)
