As used in this chapter:
FORTUNE-TELLING ACTIVITY
Is defined as any activity involving fortune-telling, phrenology, palmistry, character reading, astrology, the telling of destinies or fortunes, horoscope reading or any similar activity.
No person shall be permitted within the territorial limits of Cape May City to practice or perform fortune-telling activity without procuring a license therefor.
In addition to undergoing the normal mercantile licensing process, anyone wishing to engage in fortune-telling activity must also undergo fingerprinting and an NJSBI check with the applicable fee paid through the Cape May Police Department, which shall process same. Those required to apply for these procedures shall include all applicants, officers, directors, and stockholders holding 5% or more of capital stock of any corporation, as well as members of any partnership, association and/or organization applicant.
The fee for each license shall be $213.00 for the license year, or any part thereof, and shall be payable immediately upon application.
Fortune-telling activity shall be restricted to that part of the building or premises for which the license is granted and shall not include solicitation outside the premises or on any of the streets or public areas within the City.
No license shall be issued until a certificate is filed with the City Clerk by the City's Code Enforcement Officer, showing that the place to be licensed is in a sanitary condition and complies with the laws of the State of New Jersey and the rules and regulations of the State Board of Health.
