The office of Township Administrator, heretofore established by appointment by the Township Committee, is hereby created, continued and confirmed pursuant to N.J.S.A.A 40A:9-136 et seq. The Administrator shall be appointed by a majority vote of the Township Committee pursuant to N.J.S.A.A 40A:9-137.
A. 
The Administrator shall serve at the pleasure of the Committee; provided that the Administrator may be removed only by a 2/3 vote of the Township Committee pursuant to N.J.S.A. 40A: 9-138.
B. 
The Township Administrator shall devote full time to the duties of the office, except that nothing herein shall prevent the Administrator from also holding any other appointive office of the Township and fulfilling the duties thereof. The Township Committee reserves the right at any time to set specific hours for the Administrator by resolution.
C. 
On removal or resignation of the Administrator, the Committee may appoint a temporary Administrator to serve at the pleasure of the Township Committee, or until an Administrator is appointed pursuant to § 3-1 of this Code, whichever is sooner.
The Administrator shall be appointed on the basis of executive and administrative qualifications. Previous responsible, successful experience in local government and possession of a degree in public administration or municipal management shall be preferred.
A. 
The Administrator shall be the chief administrative officer of the Township. Under the supervision of the Committee, and to the extent permitted by law, the Administrator shall:
(1) 
Direct and supervise the administration of all departments, offices and agencies of the Township, except as otherwise provided by law.
(2) 
In consultation with the Personnel Subcommittee, recommend the creation or elimination of positions as the Administrator deems in the best interests of the Township.
(3) 
Study and assign responsibility for departmental duties and coordinate interdepartmental operations.
(4) 
Recommend to the Committee, through the Personnel Subcommittee, the appointment and, when necessary for the good of the Township, suspension or removal of department heads, except the Township Clerk, Township Engineer, Township Auditor, Township Planner, Township Attorney and personnel appointed by them.
(5) 
Consult with the Personnel Subcommittee prior to any appointment of, and when necessary for the good of the Township, suspension or removal of any other Township employee.
(6) 
Supervise the day-to-day performance of all Township employees and coordinate the activities of the Township's statutory employees and professional consultants consistent with the policies and directives of the Township Committee.
(7) 
In consultation with the Personnel Subcommittee, establish and recommend sound personnel policies and practices to the Township Committee for adoption, and see to the enforcement of those policies and practices.
(8) 
Maintain complete and accurate personnel records of all employees, in compliance with applicable laws, including but not limited to the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191 (HIPAA), and the regulations that are promulgated thereunder, as same may be amended from time to time.
(9) 
Attend all meetings of the Township Committee, with the right to take part in discussion, but not to vote.
(10) 
Require and receive from each department, office and board their annual budget requests.
(11) 
Review all budget requests and, in conjunction with the Chief Financial Officer, prepare and submit the proposed Township budget annually, including a detailed analysis of the various items of expenditure and revenue and such explanatory comments or statements as the Administrator, in consultation with the Mayor and Chief Financial Officer, deems appropriate or necessary for consideration by the Committee.
(12) 
Submit to the Committee an oral or written report on the administrative activities of the Township, as may be requested by the Committee.
(13) 
Conduct such studies and make such reports as the Committee may require concerning the operation of the Township.
(14) 
Keep the Committee fully advised as to the Administrator's evaluation of the current and future needs of the Township and make recommendations concerning the same.
(15) 
Study, recommend and implement procedures and policies of the Township and its departments for requisition, purchase, inspection, receipt, storage, distribution, internal transfer and disposal of, and standards and specifications and payment for supplies, materials and equipment.
(16) 
Perform such other duties as may be required by the Township Committee, which may modify the terms and conditions of any existing job description.
(17) 
As directed by the Township Committee or by a designated member or subcommittee thereof, and subject to Township Committee guidelines, assist the Township Committee in negotiating contracts for the Township.
(18) 
Receive and respond to inquiries and complaints concerning Township business and provide information and assistance to resolve them.
(19) 
Be responsible for financial review of the Township Police Department (which shall otherwise operate in accordance with N.J.S.A. 40A:14-118 et seq.) and approval of all departmental expenditures, which shall be made through the Purchasing Agent.
B. 
Nothing in this article shall authorize the Township Administrator to exercise the powers and duties of the Township's elected officials, its professional consultants or its boards and commissions, or those powers and duties vested by law in other Township officials.
C. 
Members of the Township Committee shall not give orders or direction to any Township employee except through the Administrator; provided that the preceding limitation shall not apply with respect to the Township Clerk or to the Township's professional consultants, including but not limited to the Township Engineer, Township Planner and Township Attorney, and provided further that members of the Committee may interact with employees for the purpose of obtaining information concerning public business or making inquiry concerning Township operations. Additionally, members of the Personnel Subcommittee may meet with Township employees in accordance with the provisions set forth in § 2-9D of this Code.
The Administrator shall be paid a salary fixed and adopted by the Committee in the annual Salary Resolution within the guidelines set forth in the Salary Ordinance. The Administrator shall receive no additional compensation for other titles held, except that if the Administrator is appointed as the Township Clerk, he or she may be paid separate compensation for that position. In such case, the Administrator shall be known as the Township Administrator/Clerk. The Administrator shall be reimbursed for all reasonable and necessary expenses incurred in the performance of the office or offices held.
