As used in this chapter, the following terms shall have the meanings indicated:
GUARDIAN
A person, other than a parent, to whom legal custody of a juvenile has been given by court order or who is acting in place of the parent or is responsible for the care and welfare of the juvenile.
JUVENILE
An individual who is under the age of 18.
PUBLIC PLACE
Any place to which the public has access, including but not limited to any public street, road, thoroughfare, sidewalk, bridge, alley, plaza, park, recreation or shopping area, public transportation facility, vehicle used for public transportation, parking lot or any other public building, structure or area.
A. 
It shall be unlawful for a juvenile to be on or upon, either on foot or upon any type of conveyance, vehicle or otherwise, any public place between the hours of 10:00 p.m. and 6:00 a.m. The provisions of this section shall not apply to a juvenile:
(1) 
When the juvenile is accompanied by his parent, guardian, or other adult person having the care and custody of the juvenile; or
(2) 
Where the juvenile is upon an emergency errand or legitimate business directed by his parent, guardian, or other adult person having the care and custody of the minor; or
(3) 
When the juvenile is gainfully employed at the time; or
(4) 
When the juvenile is an attendant as a bona fide student at an evening school of instruction; or
(5) 
When the juvenile is in attendance at a function sponsored by a religious or educational organization, association or society; or
(6) 
When the juvenile is in attendance at a properly supervised civic or private recreational function; or
(7) 
When the juvenile shall, as a result of exceptions in Subsection A(3), (4), (5) and (6), immediately above, be traveling on or upon any of the public streets or public places in the Township after the prescribed hour while returning to his residence from such activity.
B. 
In case of an emergency as provided in exception Subsection A(2) above, the juvenile shall have in his possession a note or document, signed by at least one of his parents or a guardian or other adult person having the care and custody of the juvenile, which note or document shall state the nature of the errand, the necessity therefor, the place to which the juvenile is to go and the date and hour that the note or document was issued.
If a minor is apprehended while violating this chapter the police officer or special officer so apprehending is hereby authorized and empowered to take into custody such juvenile child. Such officer shall notify the parent or guardian or adult person having the care and custody of the juvenile of the violation of this chapter and the penalty therefor. The juvenile so apprehended shall be taken into custody but may be released immediately in the custody of his parent, guardian or other adult person having the care and custody of the juvenile.
A. 
A person who violates or fails to comply with any provision of this chapter shall be subject to either or both of the following penalties:
(1) 
A fine not to exceed more than $1,000.
(2) 
Community service of not more than 30 days.
B. 
If both a juvenile and the juvenile's parent or guardian violate this chapter, they shall be required to perform community service together.
