The purpose of this chapter is to protect the
health, safety and welfare of all those frequenting this municipality.
It is further the purpose of this chapter to prevent the needless
health hazards caused by pet solid waste upon public and private properties
and to establish requirements for the proper disposal of pet solid
waste.
No person owning, harboring, keeping or in charge
of any pet shall cause, suffer or allow such pet to soil, defile,
defecate on or commit any nuisance on any common thoroughfare, sidewalk,
passageway, bypath, play area, park area, park or any place where
people congregate or walk, or upon any public property whatsoever,
or upon any private property without the permission of the owner of
said property. The restriction in this section shall not apply to
that portion of the street lying between the curblines, which shall
be used to curb such pet under the following conditions:
A. All pet owners who so curb such pet are required to
immediately and properly dispose of their pet's solid waste.
B. The solid waste removed from the aforementioned designated
area shall be properly disposed of by the person owning, harboring,
keeping or in charge of any pet curbed in accordance with the provisions
of this chapter.
C. Whenever any pet is present upon any public property
whatsoever, including streets and sidewalks, or upon any private property
without permission of the property owner, the person owning, harboring,
keeping or in charge or control of such pet shall be in possession
of a sanitary bag or other sanitary utensil the design of which permits
the removal and proper disposal of pet solid waste.
D. Any owner or keeper who requires the use of a disability assistance animal shall be exempt from the provisions of Article
IV while such animal is being used for that purpose.
