For purposes of this chapter, the terms used herein are defined as follows:
INTERSECTION
The point at which the curblines meet on intersecting streets.
STREET LINE
The curbline; the point at which the street ends and the curb begins.
The owner, possessor or tenant of each parcel of land in the municipality,
where it shall be necessary and expedient for the preservation of public health,
safety and general welfare or to eliminate a fire hazard, shall remove from
such lands all brush, weeds, dead or dying trees or any dead or dying foliage
or natural growth of any other type, stumps, roots, filth, garbage, trash,
rubbish and debris within 10 days after notice to remove same.
No person shall place, dispose of or cause to be placed or disposed
of any brush, weeds, dead or dying trees, stumps, roots or any dead or dying
foliage or natural growth of any other type on any land in the municipality.
The notices mentioned in this chapter may be served upon the owners,
possessors or tenants, whichever may be applicable, resident in the Borough
of Lavallette, in person or by leaving the same at their usual places of residence
with a member of their family above the age of 14 years. In the case of such
owners, possessors or tenants, as applicable, who shall not reside in the
Borough of Lavallette, notice may be served upon such parties personally or
be mailed to such parties' last known post office addresses.
The words “person,” “party in interest,” “owner,”
“possessor” or “tenant,” as used in this chapter,
shall include individual, individuals, partnership, corporation or association
of individuals.
Any person, firm or corporation that shall be convicted of a violation
of a provision of this chapter shall, upon conviction whereof by any court
authorized by law to hear and determine the matter, be subject to a fine of
no less than $100 and no more than $1,000, imprisonment not to exceed 90 days
or community service of not more than 90 days, or any combination of fine,
imprisonment and community service. Each day that such violation exists shall
constitute a separate offense.
