A. No building or structure hereafter constructed in
the Borough of Lavallette shall be used or occupied in whole or in
part until a certificate of occupancy shall have been issued by the
Construction Code Official in accordance with N.J.S.A. 52:27D-133
which demonstrates that all completed construction and, therefore,
the property complies with the State Uniform Construction Code.
B. No residential property shall be sold and title transferred
until the owner of the property to be sold obtains a transfer certificate
of occupancy signed by the Construction Code Official or Code Enforcement
Officer of the Borough of Lavallette demonstrating that the property
complies as to current smoke and carbon monoxide detector requirements
and all applicable zoning and property maintenance laws of this Borough,
site plans, building permits and Tax Assessor records.

A. The fee for initial inspection of property requiring a certificate of occupancy pursuant to §
17-1A shall be as established under the fee schedule adopted in Chapter
20 of this Code, Construction Codes, Uniform.
B. The fee for inspection of property requiring a certificate of occupancy pursuant to §
17-1B shall be in the amount of $100 for one unit; the fee for such inspection of additional units shall be $100 per additional unit.

Any person, firm or corporation that shall be
convicted of a violation of a provision of this chapter shall, upon
conviction thereof by any court authorized by law to hear and determine
the matter, be subject to a fine of no less than $100 and no more
than $1,000, imprisonment not to exceed 90 days or community service
of not more than 90 days, or any combination of fine, imprisonment
and community service, as such court in its discretion may impose.
Each day that such violation exists shall constitute a separate offense.
