A. 
There is hereby created and established in the Borough of Lavallette a Police Department, which shall be known as the "Lavallette Borough Police Department." The Police Department is established in accordance with the provisions of N.J.S.A. 40A:14-118 et seq.
B. 
The Mayor and Borough Council shall provide for the appointment of a Public Safety Director and/or Chief of Police and officers and personnel as they shall deem necessary for the proper and efficient operation of the Police Department. The Mayor and Borough Council shall determine the terms of office and compensation and prescribe the powers, functions and duties of all such members, officers and personnel as permitted by law.
C. 
The salary of all employees of the Borough of Lavallette Police Department shall be as designated in the Salary Ordinance[1] as adopted by the governing body.

D. 
The structure of the Lavallette Police Department shall be as follows:

(1) 
A Chief of Police or Public Safety Director;
(2) 
Police Sergeants, not to exceed four in number, at the determination of the governing body;
(3) 
Patrol officers.
E. 
Qualification of applicants for membership. Pursuant to N.J.S.A. 11A:4-1.3, entry-level law enforcement officers may be appointed by the governing body upon the recommendation of the Chief of Police or appropriate authority without taking a civil service examination, so long as the individual to be appointed has completed a full basic course for police officers training course at a school approved and authorized by the New Jersey Police Training Commission. This exemption from the civil service examination requirement shall remain in effect on a temporary basis until December 31, 2022, at which time this Subsection E shall expire unless otherwise extended by ordinance.

F. 
Anti-nepotism policy. Selection, appointment, training and promotion of police personnel shall be subject to the anti-nepotism provisions of Borough Code Chapter 45, Article IV.

A. 
Appropriate authority.
(1) 
In accordance with the provisions of N.J.S.A. 40A:14-118, the Borough Council shall designate an appropriate authority to whom the Chief of Police will be directly responsible. The Borough Council shall act as the appropriate authority unless otherwise designated by resolution of the governing body.
(2) 
The appropriate authority shall be responsible to develop appropriate rules and regulations for the government of the police force and for the discipline of its members in accordance with N.J.S.A. 40A:14-118.
(3) 
The appropriate authority shall have such duties and responsibilities as are set forth in N.J.S.A. 40A:14-118.

C. 
Chief of Police.
(1) 
Position created. The office of Chief of Police is hereby established.
(2) 
The Chief of Police shall be the head of the police force and he/she shall be directly responsible to the appropriate authority for the efficiency and routine day-to-day operations of the Police Department. The Chief of Police shall have those duties provided for by the New Jersey Department of Personnel, as set forth in this Code, under New Jersey Law and the Borough of Lavallette Police Manual and Rules and Regulations

E. 
Sergeant.
(1) 
Position created. The office of Sergeant of Police of this Borough is hereby established.
(2) 
Duties. The Sergeant designated in writing by the Chief of Police shall be in charge of said Police Department during the absence of the Chief of Police. A Sergeant shall have those duties provided for by the New Jersey Department of Personnel, as set forth in this Code, under New Jersey Law and the Borough of Lavallette Police Manual and Rules and Regulations.
F. 
Police officer.
(1) 
Position created. The office of police officer is hereby established.
(2) 
Duties. Police officers shall have those duties provided for by the New Jersey Department of Personnel, as set forth in this Code, under New Jersey Law and the Borough of Lavallette Police Manual and Rules and Regulations.
G. 
Part-time police officers.
(1) 
Position created. There is hereby created the position of part-time police officer for the Borough of Lavallette.
(2) 
Duties; hours. Part-time police officers shall have those duties provided for by the New Jersey Department of Personnel, as set forth in this Code, under New Jersey Law and the Borough of Lavallette Police Manual and Rules and Regulations. Part-time police officers shall work an average of less than 35 hours per week.
(3) 
Qualifications. To be appointed to the position of part-time police officer, an individual must meet all the requirements for qualifications of full-time police officers as prescribed under applicable state law and the Department of Personnel regulations.
H. 
Communications operator.
(1) 
Position created. The position of communications operator in this Borough is hereby established.
(2) 
Duties. Communications operators shall have those duties provided for by the New Jersey Department of Personnel and as set forth in this Code. Communications operators shall keep proper records and files and perform any other police office work as requested by the Chief of Police.

Such other officers and personnel as the Borough Council deems necessary for proper operation of the Police Department.

A Detective Bureau is hereby established for the Police Department for the Borough of Lavallette and it shall consist of detectives assigned from time to time as hereinafter provided.
A. 
The office of detective is hereby established. A detective shall conduct criminal investigations while in civilian clothing and shall conduct preparation of cases for prosecution and perform such other duties as are from time to time assigned by the Chief of Police.
B. 
Detectives shall be assigned by the Chief of Police, who shall also have the right in the case of an emergency to make a temporary assignment to the Detective Bureau. Temporary assignment to the Detective Bureau will not extend beyond 90 days.
C. 
Any officer appointed as detective shall receive the same compensation as would otherwise be received for that office unless the Borough Council, by ordinance, provides additional or different compensation for a detective.
