Any business establishment offering for sale used motor vehicles and
displaying said vehicles outdoors shall not be located closer than 1,600 feet,
measured along the shortest highway route, to the nearest other business establishment
with an outdoor display of such vehicles for sale. Nothing contained herein
shall prohibit any bona fide new car dealer from offering for sale or displaying
used cars outdoors as an adjunct of said new car dealership.
The outdoor lighting of any such business establishment shall be so
designed that it does not cause a traffic hazard and so that the glare and
distraction to persons using the highway shall be kept at a minimum.
The violation of any of the provisions of this chapter shall, upon conviction,
be punishable by one or more of the following: imprisonment not to exceed
90 days or a fine not to exceed $1,000 or a period of community service not
to exceed 90 days. Each twenty-four-hour period that any violation continues
to exist shall be deemed to be a separate offense and shall be punishable
as aforesaid.
